Minor Deficiencies. Minor Deficiencies means any defects, deficiencies and items of outstanding Work (including in relation to any seasonal Work) which would not materially impair the Owner’s use and enjoyment of the Work and includes any damage to the work of the Owner’s own forces or the work of the Owner’s other contractors caused by the Contractor.

Minor Deficiencies. (a) In the event that Minor Deficiencies exist when Project Co gives the Substantial Completion Notice, the Independent Certifier, in consultation with Project Co and HHS, shall prepare a list of all Minor Deficiencies (the “Minor Deficiencies List”) identified at that time and an estimate of the cost and the time for rectifying such Minor Deficiencies.
Minor Deficiencies. (a) In the event that Minor Deficiencies exist when Project Co gives a Substantial Completion Notice, the Independent Certifier, in consultation with Project Co and the Ministry, shall, within 15 Business Days of Project Co’s application, prepare a list of all Minor Deficiencies (the “Minor Deficiencies List”) identified at that time and an estimate of the cost and the time for rectifying such Minor Deficiencies.

Any defects, deficiencies and items of outstanding Work located inside the security perimeters (i) that compromise safety, security or emergency response capability shall be deemed not to be Minor Deficiencies; or (ii) that do not compromise safety, security or emergency response capability shall be deemed to include as part of the cost of remedy all extra security costs, operational change costs and shift premiums necessary to facilitate the security necessary to allow the Contractor or Subcontractor to access inside the security perimeter safely.

Minor Deficiencies. For the purposes of GC 5.8.3 and any holdback to be taken as contemplated thereunder, the value of such outstanding Phase 1 Deliverables shall, without regard to the degree or quantum of such outstanding Phase 1 Deliverables, be set at [REDACTED]. Failure to submit any of the Phase 1 Deliverables that are required for the safe occupation and use of the Phase 1Work and, as may be necessary for the security and health of the occupants of the Project, shall be grounds for the Consultant to state in its report that Completion of the Phase 1 Work has not been achieved. The assignment by the Contractor of all guarantees and warranties shall expressly reserve the right of the Contractor to make any claims under such guarantees and warranties, for the repair or replacement of the Work, and such assignment shall in no way prejudice any rights of or benefits accruing to the Contractor pursuant to such guarantees and warranties. For greater certainty, nothing herein is intended to constitute a release or waiver of the obligation of the Contractor to submit and assign (as applicable) to the Owner all of the Phase 1 Deliverables.
