Minimum Fleet Size; Fleet Reallocation. (a) The Vendor that has been approved for Permit A must maintain a fleet of at least two-thousand (2,000) bikes, unless otherwise allowed by the Program Manager. (b) If the Vendor does not deploy its minimum fleet size as measured in Requirement CE5.3, then the Program Manager may notify the Vendor in writing of SDOT’s intent to reallocate the Vendor’s unused fleet capacity. If the Vendor does not reach and maintain its minimum fleet size within fifteen (15) days after the Vendor receives the notice, then the Program Manager may temporarily or permanently reallocate all or part of the Vendor’s unused fleet capacity to one or more other Vendors or prospective Vendors. (c) The reallocation will be temporary if the Vendor: 1. discloses in its permit application that it intends to deploy fewer devices than its minimum fleet size; 2. provides a fleet deployment schedule to the Program Manager’s satisfaction; and 3. complies with that schedule.
