Common use of Minimum Daily Hours Clause in Contracts

Minimum Daily Hours. (a) Subject to the exceptions set forth in this Section, any employee reporting for work on his regular shift shall receive a minimum of four (4) hours' pay at his regular wage rate. (b) Any employee completing the first half of his regular shift, and who commences work on the second half of his regular shift, shall receive a minimum of eight (8) hours' pay at his regular wage rate, provided that: PROVIDED THAT if four or eight hours in (a) or (b) above is not available at his regular job, the employee shall perform such temporary work as may be assigned to him to qualify for such pay. The provisions of this Section shall not apply in the event of an emergency such as fire, flood, power failure, etc., beyond the control of the Company or if: A. He voluntarily quits or lays off; or is discharged for cause, B. He was previously instructed not to report, and in any such event or circumstance he shall be paid for the actual time worked at regular wage rates.
