Military Service Benefits. (A) Seniority During Military Service Regular employees who leave the service of the City to enter that of the United States Armed Forces, or the services of the U.S. Maritime Commission, or who are drafted by the United States Government for civilian service, will upon their return within ninety (90) days from the release of such services, be granted all seniority rights as if continuously employed by the City during such service. Sick days and other benefits to which such employee is entitled, accrued prior to the date of the employee’s entrance into the military service shall be preserved until his return to City employment. Whenever vacancies occur in the classified service by reason of military leaves of absence, appointments may be made for the duration of the emergency or earlier return to service of the employees granted such leaves for military service. All such appointments shall be subject to the priority rights of the permanent employees granted military leave.

Military Service Benefits. (1) Upon reemployment of an employee who has qualified for USERRA leave and who has been actively deployed for at least one year of such leave, s/he shall be paid a month’s salary on his her first regular pay day based upon his/her average monthly earnings for the twelve month period immediately prior to his her entry into service. This same benefit figured in a like manner will be paid to the heirs of an eligible employee, upon proper claim, in the event of the death of such employee while on military leave. These benefits are not payable to employees inducted under any short service reserve program.

Payment will be made when the employee returns to work upon presentation of satisfactory proof of the amount of military pay received. A written statement on the Company form provided signed by the Finance or Disbursing Officer of the field to which the employee was sent is acceptable as proof. This statement should specify separately the amount of base pay the employee received and the amounts of various allowances, if any. If any other employee is required by the government to report for examination during working hours in order that his physical fitness for military service may be determined, he will be entitled to time off with pay for the time required at his regular straight time hourly rate.
