Merchandise and Services. Subject to the terms of this Contract, Purchaser agrees to purchase the Cemetery Merchandise and Services at the current retail price established herein by paying Seller in the manner set forth in this Contract (Sections I & II), and upon the death of the Contract Beneficiary, the Seller shall furnish the Cemetery Merchandise and Services as set forth in the Statement of Cemetery Merchandise and Services Selected above, regardless of the cost of the merchandise or service at the date of the death of the Contract Beneficiary (see Disclosures 5 & 6). The Provider will be entitled to all trust funds on deposit including income (Sections I & II), even if in excess of the cost of Merchandise and Services at the time of the Contract Beneficiary’s death. This Contract provides benefits in the form of Cemetery Merchandise and Services only, unless Non-Guaranteed Cash Advance Benefits are specified above. Prior to selecting the Cemetery Merchandise and Services, Purchaser acknowledges receipt of the General Price List, and that the Casket Price List and the Outer Burial Container Price List were made available to him/her. Merchandise and Services. The Operator shall have the right to select all merchandise, articles and services sold, rented or furnished pursuant to the rights granted by this Article XI. Such items and services shall conform and comply, in all respects, with all federal, state and local laws and regulations. The Lessee shall have the right to require the Operator to stop selling, renting or furnishing any such item or service which the Lessee decides, in its reasonable judgment, is of poor quality, unsatisfactory in nature, or harmful or dangerous to the health or safety of the public or contrary to Baseball Rules and Regulations.
Merchandise and Services. During the term hereof, Licensee shall maintain in said Department a complete stock of merchandise to be sold therein, the quantity and quality thereof being subject to the approval of Sears.
