Mediation Generally Sample Clauses
Mediation Generally. If a Dispute cannot be resolved pursuant to Section 13.1 (Escalation), the Parties agree to try in good faith to resolve any such Dispute by non-binding mediation administered by JAMS End Dispute in accordance with its commercial mediation rules. The mediation will be conducted by a single mediator appointed by agreement of the Parties who will have previous judicial experience, or failing such agreement by JAMS End Dispute in accordance with its commercial mediation rules. Unless otherwise mutually agreed upon by the Parties, the mediation proceedings will be conducted in Chicago. The Parties agree that they will share equally the cost of the mediation, including filing and hearing fees, and the cost of the mediator(s). Each Party will bear its own attorneys’ fees and associated costs and expenses.
Mediation Generally. Either party may request mediation of any dispute arising under this Comprehensive Agreement, whether technical or otherwise. All claims arising out of this Comprehensive Agreement or its breach shall be submitted first to mediation in accordance with the local rules for mediation in Palm Beach County, Florida. The parties shall share the mediator’s fee equally. The mediation shall be held in Palm Beach County, unless another location is mutually agreed upon.
