Means of Access. Perfect shall provide Company unique login credentials and Passcode(s) to access the Services. Company is responsible for maintaining the confidentiality of the Passcode(s) and will be solely liable for all activities that occur under Company’s login identification credentials. Company shall immediately notify Perfect of any unauthorized use of any credentials and shall immediately change any affected Passcode(s). Company agrees to access the Services in a secure manner in compliance with Perfect’s reasonable standards established from time to time which currently require Company’s use of web browsers utilizing 128 bit SSL encryption. Perfect, in its sole discretion, may specify connectivity standards to access the Services when applicable. The credentials of Companies not meeting these standards may be terminated or suspended at any time.

Means of Access and loading facilities 7.1 The consignor shall ensure that there will at all times be at the place where the carrier is to load and take delivery of the consignment safe and adequate access and loading facilities and that it is possible for the carrier to do so without the need for any special or additional tackle, plant, power, labour or equipment. 7.2 In the event of the condition in 7.1 not being fulfilled, the carrier may elect either to resile from the agreement, in which event the carrier will not be liable for any loss or damage suffered by the consignor or the consignee in consequence thereof, or to accept the agreement. Where the carrier elects to accept the agreement, it will have the right to use such additional tackle, plant, power, equipment or labour as it may in its own sole and absolute discretion deem fit, in which event the consignor will be liable for all reasonable expense incurred by the carrier with regard to such use, including the hiring thereof, and such expense will be presumed to be reasonable until the contrary is proved by the consignor. 7.3 The carrier will not be liable to the consignor in respect of any damage to the consignment arising out of the use of any such additional tackle, power, equipment, and the consignor indemnifies the carrier against any loss or damage arising out of any injury to the servants or property of the carrier or any third person by reason of any defect in such tackle, plant, power, or equipment or the negligence of such labour.
Means of Access. During the term of this Agreement, GCAR agrees to provide to Vendor access to the Data Set via the Internet using the Real Estate Transaction Standard service (“RETS”).
