Material Misrepresentation Clause Samples

Material Misrepresentation. The Owner makes a material misrepresentation to one or more parties to the RFA; otherwise fails to comply with the terms of this RFA; or is in default, beyond any applicable cure period, under any agreement between the Owner and the Secretary.

Material Misrepresentation. Any representation made by either CCI or Contractor hereunder shall be deemed false or incorrect in a material respect when made, or deemed false in a material respect at any point in time, if said representation is one which CCI or Contractor has a continuing duty to make.
