All dogs had been positioned in sternal recumbency, with the limb of interest extended, ensuring there was no supination or pronation of the elbow. For each elbow three dimensional multiplanar reconstruction (MPR) views were created using OsiriX (version 5.6 32-bit, Pixmeo, Geneva) open source DICOM viewer, permitting transverse, dorsal and sagittal images to be viewed concurrently. Repeatable slice alignment was achieved by aligning slices with the caudal cortex of the ulna in the sagittal view and lateral aspect of the ulna in the dorsal view (Fig 1). Once the alignment was complete, the sagittal view was used to center the image on the most cranial part of the proximal ulna, immediately distal to the humeral condyle resulting in a repeatable standardised transverse image through the apex of the MCP. The transverse plane was chosen as the medial coronoid process is best defined in this plane (\u2587\u2587\u2587\u2587\u2587\u2587\u2587 1999). A window width of 3500 HU as previously recommended (\u2587\u2587\u2587\u2587\u2587\u2587\u2587\u2587 et al. 2007) and window level of 700 HU were used. A single transverse image for each elbow was archived as a JPEG file. Four board certified orthopaedic surgeons, two board certified radiologists, one diagnostic imaging resident and one surgical resident reviewed individually a single transverse CT image of the ulna at the level of the medial coronoid process from each elbow included in the study. All except one of the observers had been working together in the same institution for at least six months prior to the study. Each observer was asked to draw a line on the transverse CT image representing where, if present, they considered the junction between the normal and the sclerotic trabecular bone pattern to be delineated. This measurement was made on each transverse CT image by the eight observers twice (separated by 4 weeks). A single observer (XX) then used a sclerometer to quantify, as a percentage, the position of the observer\u2019s line demarcating the transition between normal and sclerotic trabecular bone. The use of a sclerometer was firstly reported by \u2587\u2587\u2587\u2587\u2587 et al. (2009) who applied the technique to quantify ulna sclerosis on lateral radiographs of the elbow from dogs with MCPD. Here, we applied the instrument to transverse CT images of the ulna at the level of the MCP. The sclerometer (Fig 2A) was superimposed on the image with the cranial line of the sliding scale being aligned with the most cranial cortex of the medial coronoid process of the ulna and the caudal line intersecting the most caudal cortex of the ulna. The hinged sclerometer line was then aligned with the line drawn by the observers (Fig 2B). If sclerosis was not deemed present the score was recorded to be 0%. (Fig 3) Each observers recorded whether they considered the ulna and medial coronoid process to be normal or abnormal, and they assessed images for the presence or absence of pre- determined variables (Table 1). Images were presented in a random sequence and observers did not communicate with each other. In addition to these binary variables, observers were requested to grade images using a four point ordinal grading scheme, with grade 0 representing a normal MCP and grade IV representing the MCP entirely sclerotic (Table 2). To assess intraobserver variability, each observer reviewed all CT images twice, with the same assessment criteria as in experiment 2, on occasions separated by at least four weeks. The order of the images presented to the observers was randomly assigned for the purpose of blinded image reading. \u2587\u2587\u2587\u2587\u2587\u2019\u2587 kappa (\u0199) for nominal data (experiment 2 and 3) and intraclass correlation coefficient (ICC(2,1)) for numeral values (experiment 1) were calculated to evaluate inter- and intraobserver agreement between the eight observers, and for each category of observers: surgeons (including board certified and resident), diagnostic imagers (including board certified and resident), board certified orthopaedic surgeons, board certified diagnostic imagers, board certified (including diagnostic imagers and surgeons). In the event a third (3rd) party insurance carrier refuses to reinstate such employee to full temporary total disability benefits, the Employer shall be required to pay the difference between the amount of the ben- efit paid by such third (Jrd) party insurer and full total tempo- rary disability benetits. Determination of physical capabilities shall be based on the attending physicians medical evaluation. Under no conditions will the injured employee be required to perform work at that location subject to the terms and condi- tions of the National Agreement or its Supplements and/or Riders, provided that such employee may be required to per- form letter scanning, sorting, and re-weighing in a manner consistent with physician's restrictions. Prior to acceptance of modified work, the affected employee shall be furnished a written job description of the type of work to be performed. The modified workday and workweek shall be established by the Employer within the limitations set forth by the attending physician. However, the workday shall not exceed eight (8) hours, inclusive of coffee breaks where applicable and exclu- sive of a one-half (1/2) hour meal period and the workweek shall not exceed forty (40) hours, Monday through Friday, or Tuesday through Saturday, unless the nature of the modified work assignment requires a scheduled workweek to include Sunday. Whenever possible, the Employer will schedule \u2587\u2587\u2587\u2587 tied work during daylight hours, Monday through Friday, or during the same general working hours and on the same workweek that the employee enjoyed before he/she became injured. In the case of an employee whose workdays and/or hours routinely varied, the Employer will schedule the employee based on the availability of the modified assignment being offered. Any alleged abuse of the assignment of work- days and work hours shall be subject to the grievance proce- dure. Modified work time shall be considered as time worked when necessary to satisfy vacation and sick leave eligibility require- ments as set forth in the National Agreement, Supplements and/or Riders. In addition to earned vacation pay as set forth in the applicable Supplements and/or Riders, employees accepting \u2587\u2587\u2587\u2587 tied work shall receive prorated vacation pay for \u2587\u2587\u2587\u2587 tied work performed based on the weekly average modi tied work pay. The only time modified work is used in prorating vacation is when the employee did not qualify under the applicable Supplements and/or Riders. Holiday pay shall first be paid in accordance with the provi- sions of the applicable Supplements and/or Riders as it relates to on-the-job injuries. Once such contractual provisions have been satisfied, holidays will be paid at the modified work rate which is the modified work wage plus the temporary partial disability benetit. \u2587\u2587\u2587\u2587 leave and funeral leave taken while an employee is per- forming modified work will be paid at the modi tied work rate, which is the modified work wage plus the temporary partial dis- ability benefit. Unused sick leave will be paid at the applicable contract rate where the employee performed modified work and qualified for the sick leave during the contract year. The Employer shall continue to remit contributions to the appropriate Health & Welfare and Pension trusts during the entire time period employees are performing modified work. The payment of Health & Welfare and Pension contributions while the employee is on modified work is not included in the Health & Welfare and Pension contributions required by the Supplement when an employee is off work on worker's com- pensation. Continuation of such contributions beyond the period of time specified in the Supplements and/or Riders for on-the-job injury shall be required. Provisions of this Section shall not be utilized as a reason to disqualify or remove an employee from the modified work program. Employees accepting modi tied work shall receive temporary partial benefits as determined by each respective state worker's compensation law, plus a modified work wage when added to such temporary partial benefit, shalt equal not less than eighty- live percent (85%) of forty (40) hours pay he/she would other- wise be entitled to under the provisions of the applicable Supplements and/or Riders for the tirst six (6) months from the date the moditied work assignment commences. After this ini- tial six (6) month period, the percentage shall increase to ninety percent (90%) for the duration of each individual modi tied work assignment. The Employer shall not refuse to assign moditied work to employees based solely on such employees reaching the ninety percent (90%) wage level. Such refusal shall be consid- ered an abuse of the program and shall be subject to the griev- ance procedure. Moditied work assignments beginning or end- ing within a workweek shall be paid on a prorated basis; one (I) day equals one-tifth (1/5th). Employees accepting modi tied work shall not be subject to disciplinary action provisions of the Operational Supplements, Regional Supplements and/or Local Riders unless such \u2587\u2587\u2587\u2587\u2587- tion involves an offense for which no prior warning notice is required under the applicable Supplement or Rider (Cardinal Sins). Additionally, the Uniform Testing Procedures set forth in the National Agreement shall apply. -t Alleged abuses of the modified work program by the Employer and any factual grievance or request for interpretation concern- ing this Article shall be submitted directly to the Regional Joint Area Committee. Proven abuses may result in a determination by the National Grievance Committee that would withdraw the benefits of this Article from that Employer, in whole or in part, in which case affected employees shall immediately revert to full worker's compensation benefits.\nSection 3. Americans with Disabilities Act The Union and the Employer recognize their obligations under the Americans with Disabilities Act. It is agreed that the Employer shall determine whether an employee is a qualified individual with a disability under the ADA and, if so, what reasonable accommodations, if any, should be provided. In the event that the Employer determines that a reasonable accommodation is necessary, the Employer shall notify the Local Union before providing the reasonable accommodation to a qualitied bargaining unit employee to ensure that the rea- sonable accommodation selected by the Employer does not impact another employee's seniority or other contract rights. Any dispute over whether the Employer complied with its duty to notify the Local Union before implementing a proposed rea- sonable accommodation or whether providing the reasonable accommodation violates any employee's rights under any other provision of the National Agreement shall be subject to the grievance procedure.
