Marx means any word, name, symbol or device used by a Person to identify its goods or services, whether or not registered, and any right that may exist to obtain a registration with respect thereto from any governmental authority and any rights arising under any such application. As used in this Agreement, the term "Marx" xncludes trademarks and service marks.
