Managerial Rights. Subject to the provisions of this Agreement, the Board, through its administrative staff, shall be free to exercise all of its managerial rights and authority to the extent permitted by law.
Managerial Rights. Subject only to limitation by this Agreement, the City has full authority to exercise the functions of management, and to direct the working forces of the City.
Managerial Rights. The Union recognizes that it is the function of the Employer to exercise the regular and customary function of management and to direct the working forces of the Employer, subject to the terms of this Collective Agreement.
Managerial Rights. 5.01 The Bargaining Agent recognizes and acknowledges that the Employer has and shall retain the exclusive right and responsibility to manage its operation in all respects including, but not limited to, the following:

(b) to direct the working forces including the right to decide on the number of employees, to organize and assign work, to schedule shifts and maintain order and efficiency, to discipline employees including suspension and discharge for just cause; and it is expressly understood that all such rights and responsibilities not specifically covered or modified by this Agreement shall remain the exclusive rights and responsibilities of the Employer. Such rights will not be exercised in a manner inconsistent with the express provisions of this Agreement.
5.02 New NPF employees may be released during their probationary period for cause. The employee may have access to the grievance procedure to the second level but may not refer a grievance to adjudication.

Managerial Rights. The provisions of Part I, 4.01 shall apply to part-time operators. The City may discipline or discharge part-time operators for proper cause.
Managerial Rights. Except as otherwise provided in this Master Contract and statutes of the State of Minnesota, the Association recognizes that the School Board has the authority to manage and direct in behalf of the public all the operations and activities of Independent School District 622 to the extent authorized by law, and that all management rights and management functions not expressly delegated in this Agreement are reserved to the School Board subject to the rights of the exclusive representative to meet and confer as provided in the PELRA.

Managerial Rights. 4.01 The Union acknowledges that it is the function of the Company, subject to the terms and conditions of this Agreement, to hire, promote, demote, transfer employees, and also the right of the Company to discipline or discharge any employee for just cause, provided that such action may be the subject of a grievance, and dealt with as provided elsewhere in this Agreement.
4.02 The Union further recognizes the right of the Company to operate and manage its business in accordance with its commitments and responsibilities and the Company agrees that it will not exercise this right in a manner inconsistent with the provisions of this Agreement.
4.03 The Company shall have the right from time to time to make or alter rules and regulations which in its discretion are deemed necessary for the safe, continuous and efficient operation of its business, provided that no such rule or regulation shall be inconsistent with the terms of this Agreement.
Managerial Rights. 13.01 The Union acknowledges that it is the exclusive function of the Company to hire, promote, demote, classify, transfer and suspend employees, and also the right of the Company to discipline, suspend or discharge any employee for just cause, provided that a claim by an employee who has acquired seniority that he has been discharged, disciplined or suspended without just cause may be the subject of a grievance and dealt with as hereinafter provided.
13.02 The Union further recognizes the right of the Company to direct the working force and operate and manage its business in all respects in accordance with its commitments and responsibilities. The location of the plants, the products to be manufactured, the schedules of productions, the methods, processes and means of manufacturing used, the right to decide on the number of employees needed by the Company at any time, the right to use improved methods, machinery and equipment, and jurisdiction over all operations, building, machinery and tools are solely and exclusively the responsibility of the Company. The Company also has the right to make and alter from time to time, reasonable rules and regulations to be observed by the employees.
13.03 It is agreed that none of the rights set forth in this Article will be exercised in a manner inconsistent with the provisions of this Agreement.
