MAINTENANCE/INSPECTION. TENANT agrees that they have fully inspected the premises and accepts the condition of the premises in 'as is' condition with no warranties or promises express or implied. TENANT shall maintain the premises in good, clean and tenantable condition throughout the tenancy, keep all plumbing fixtures in good repair, use all electrical, plumbing, heating, cooling, appliances and other equipment in a reasonable manner, removing all garbage in a clean and sanitary manner. In the event TENANT or TENANT'S guests or invitees cause any damage to the premises, LANDLORD may at its option repair same and TENANT shall pay for the expenses of same on demand or LANDLORD may require TENANT repair same, all charges incurred as additional rent. TENANT is responsible for the expense of any service calls requested by TENANT deemed to be unwarranted or unnecessary by the service technician, or if the service technician deems the service call need is due to the TENANT’S misuse, or if the service technician is unable to gain access due to TENANT’S actions, even if the other terms of this lease would ordinarily make the LANDLORD responsible for such a service call charge. TENANT will be responsible for the following items: A/C filters, locks/keys, smoke alarm batteries, windows, screens, toilet flappers, loose or broken handles and/or knobs or hinges, blinds, remotes and remote batteries, adjustments for garage door sensors if home supplies a garage door opener (if under $100.00 for service call), cleaning of mailbox as needed, sprinkler heads, refrigerator filter, light bulbs interior and exterior. TENANT shall also be fully responsible for, and agrees to maintain and repair at TENANT'S expense, the following: A/C FILTERS, SMOKE ALARM BATTERIES, EXTERMINATION INTERIOR and EXTERMINATION EXTERIOR. In the event a major repair to the premises must be made which will necessitate the TENANT'S vacating the premises, LANDLORD may at its option terminate this agreement and TENANT agrees to vacate the premises holding LANDLORD harmless for any damages suffered if any. TENANT shall notify LANDLORD immediately of any maintenance need or repair in writing. MAINTENANCE/INSPECTION. During the term of the Loan Agreement, Customer shall, unless Lender shall otherwise consent in writing: (a) maintain conspicuously on any Equipment such labels, plates, decals or other markings as Lender may reasonably require, stating that Lender has a security interest in such Equipment; (b) furnish to Lender such information concerning the condition, location, use and operation of the Equipment as Lender may reasonably request; (c) permit any person designated by Lender to visit and inspect any Equipment and any records maintained in connection therewith at all reasonable times, provided, however, that the failure of Lender to inspect the Equipment or to inform Customer of any noncompliance shall not relieve Customer of any of its obligations hereunder; and (d) make no additions, alterations, modifications or improvements (collectively, “Improvements”) to any item of Equipment that are not readily removable without causing material damage to such item of Equipment or which will cause the value, utility or useful life of such item of Equipment to materially decline. If any such Improvement is made and cannot be removed without causing material damage or decline in value, utility or useful life (a “Non-Severable Improvement”), then Customer warrants that such Non-Severable Improvement shall immediately become subject to Lender’s security interest upon being installed and shall be free and clear of all liens and encumbrances, other than Lender’s security interest, and shall become Equipment subject to all of the terms and conditions of the Loan Agreement.

MAINTENANCE/INSPECTION. Guest agrees that the premises have been fully inspected and accepts the condition of the premises in “as-is” condition with no warranties or promises express or implied. Guest shall maintain the premises in good, clean, and tenantable condition throughout the tenancy, use all electrical, plumbing, heating, cooling, appliances and other equipment in a reasonable manner, removing all garbage in a clean and sanitary manner. In the event Guest or Guest’s guests or invitees cause any damage to the premises, Rod & Reel Resort LLC may at its option repair same and Guest shall pay for the expenses of same on demand as additional rent. In the event a major repair to the premises must be made which will necessitate the Guest’s vacating the premises, Rod & Reel Resort LLC may at its option terminate this agreement and Guest agrees to vacate the premises holding Rod & Reel Resort LLC and Owner harmless for any damages suffered, if any. MAINTENANCE/INSPECTION a. Services Provided Maintenance Inspections for equipment and components will be provided by a qualified Heidelberg service technician. The appropriate type of inspection may vary somewhat depending on the applicable maintenance interval. The Heidelberg service technician will perform a thorough on-site Maintenance Inspection following the Heidelberg Maintenance Checklist for inspections performed at the applicable interval. The customer will be informed about any recommended repair service and parts repair or replacement. A Maintenance Inspection is normally performed approximately ten (10) months after the start of service under the SystemService. b. Scheduling of Maintenance Inspection Maintenance Inspection scheduling will be determined between Heidelberg and the customer. Maintenance Inspections will be performed during regular service hours, Monday through Friday from 8 a.m. to 5 p.m. local time. If the customer would like to have the Maintenance Inspection performed after these hours or on weekends, straight time charges will apply and be charged separately from SystemService at Heidelberg’s then current rates and Travel related expenses.
