Common use of Maintenance by Tenant Clause in Contracts

Maintenance by Tenant. Tenant shall at all times keep the Premises (including all entrances and vestibules) and all partitions, window and window frames and mouldings, glass, store fronts, doors, door openers, fixtures, equipment and appurtenances thereof (including lighting, heating, electrical, plumbing, ventilating and air conditioning fixtures and systems and other mechanical equipment and appurtenances serving the Premises) and all parts of the Premises, and parts of Tenant's Work not on the Premises, not required herein to be maintained by Landlord, in good order, condition and repair and clean, orderly, sanitary and safe, damage by unavoidable casualty excepted, (including but not limited to doing such things as are necessary to cause the Premises to comply with applicable laws, ordinances, rules, regulations and orders of governmental and public bodies and agencies (not requiring structural repairs unless due to Tenant's particular use of the Premises), such as but not limited to the Xxxxxxxx-Xxxxxxx Occupational Safety and Health Act). If replacement of equipment, fixtures and appurtenances thereto is necessary, Tenant shall replace the same with new or completely reconditioned equipment, fixtures and appurtenances, and repair all damages done in or by such replacement. If Tenant fails to perform its obligations hereunder, Landlord without notice may, but shall not be obligated to, perform Tenant's obligations or perform work resulting from Tenant's acts, actions or omissions and add the cost of the same to the next installment of Minimum Monthly Rent due hereunder to be repaid in full.

Damage by unavoidable casualty excepted, (excepted including but not limited to doing such things as are necessary to cause the Premises to comply with applicable laws, ordinances, rules, regulations and orders of governmental and public bodies and agencies (not requiring structural repairs unless due to Tenant's particular use of the Premises), such as but not limited to the Xxxxxxxx-Xxxxxxx Occupational Safety and Health Act)agencies. If replacement of equipment, fixtures and appurtenances thereto is are necessary, Tenant shall replace the same with new or completely reconditioned equipment, fixtures and appurtenancesappurtenances of the same quality, and shall repair all damages done in or by such replacement. If Tenant fails to perform its obligations hereunder, Landlord without notice may, but shall not be obligated to, to perform Tenant's obligations or perform work resulting from Tenant's acts, actions or omissions and add the cost costs of the same to the next installment of Minimum Monthly Rent minimum monthly rent due hereunder to be repaid in fullhereunder, together with interest thereon at the rate of eighteen percent (18) per annum.

Maintenance by Tenant. Tenant shall Except as provided in Section 8.05 hereof, TENANT shall, at TENANT’S expense, at all times keep the Premises (including all entrances interior and vestibulesexterior) and all partitions, window and window frames and mouldings, glass, store fronts, doors, door openers, fixtures, equipment and appurtenances thereof (including lighting, heating, electrical, plumbing, ventilating and air conditioning fixtures and systems and other mechanical equipment and appurtenances serving the Premises) and all parts of the Premises, and parts of Tenant's Work not on the Premises, not required herein to be maintained by Landlord, thereto in good order, condition condition, and repair and repair, clean, orderlysanitary, sanitary and safe, damage by unavoidable casualty excepted, (including but not limited to doing such things as are necessary to cause the Premises to comply with applicable laws, ordinances, rules, regulations and orders of governmental and public bodies and agencies (not requiring structural repairs unless due to Tenant's particular use of the Premises), such as but not limited to the Xxxxxxxx-Xxxxxxx Occupational Safety and Health Act). If replacement of equipment, fixtures fixtures, and appurtenances thereto is necessary, Tenant shall replace all broken glass (with glass of the same with new or completely reconditioned equipmentsize and quality) and shall, fixtures in a manner satisfactory to LANDLORD, decorate and appurtenances, paint the Premises when necessary to maintain at all times a clean and repair all damages done in or by such replacementslightly first class appearance. If Tenant In the event TENANT fails to perform any of its obligations hereunderas required hereunder upon not less than ten (10) days prior written notice, Landlord without notice LANDLORD may, but shall not be required to, perform and satisfy same with TENANT hereby agreeing to reimburse LANDLORD, as Additional Rent, for the cost thereof promptly upon demand. TENANT shall make any and all additions, improvements, alterations, and repairs to or on the Premises other than those required for the structural repair of the roof, foundation, or exterior walls, which may at any time be required or recommended by any lawful authorities, insurance underwriters, Inspection Rating Bureaus, or insurance inspectors designated by LANDLORD. LANDLORD may, but shall not be obligated to, perform Tenant's obligations deal directly with any authorities respecting their requirements for additions, improvements, alterations, or perform repairs. All such work resulting from Tenant's actsshall be performed in a good and workmanlike manner. All TENANT work (as set forth in Exhibit C) and all additions, actions or omissions improvements, and add alterations shall become the cost property of the same to LANDLORD upon the next installment expiration or earlier termination of Minimum Monthly Rent due hereunder to be repaid in fullthis Lease.

Tenant shall at all times times, at Tenant's sole cost and expense, keep the Premises (including all entrances and vestibules) and all partitions, window and window frames and mouldings, glass, store fronts, doors, door openers, fixtures, equipment and appurtenances thereof (including lighting, heating, electrical, plumbing, ventilating and air conditioning fixtures and systems and other mechanical equipment and appurtenances serving the Premisesappurtenances) and all parts of the Premises, and parts of Tenant's Work not on the Premises, not required herein to be maintained by Landlord, in good order, condition and repair and clean, orderly, sanitary and safe, damage by unavoidable casualty excepted, (including but not limited to doing such things as are necessary to cause the Premises to comply with applicable laws, ordinances, rules, regulations and orders of governmental and public bodies and agencies (not requiring structural repairs unless due to Tenant's particular use of the Premises)agencies, such as but not limited to the XxxxxxxxAmericans with Disabilities Act of 1990 and the Willxxxx-Xxxxxxx Occupational Xxxupational Safety and Health Act). If replacement of equipment, fixtures and appurtenances thereto is necessary, Tenant shall replace the same with new or completely reconditioned equipment, fixtures and appurtenances, and repair all damages done in or by such replacement. If Tenant fails to perform its obligations hereunder, Landlord without notice may, but shall not be obligated to, perform Tenant's obligations or perform work resulting from Tenant's acts, actions or omissions and add the cost of the same to the next installment of Minimum Monthly Rent due hereunder to be repaid in fullhereunder.

Subject to Section 9.1, Tenant shall at all times times, at Tenant's sole cost and expense, keep the Premises (including all entrances and vestibules) and all partitions, window and window frames and mouldings, glass, store fronts, doors, door openers, fixtures, equipment and appurtenances thereof (including lighting, heating, electrical, plumbing, ventilating and air conditioning fixtures and systems and other mechanical equipment and appurtenances serving the Premisesappurtenances) and all parts of the Premises, and parts of Tenant's Work not on the Premises, not required herein to be maintained by Landlord, in good order, condition and repair and clean, orderly, sanitary and safe, damage by unavoidable casualty excepted, (including but not limited to doing such things as are necessary to cause the Premises to comply with applicable laws, ordinances, rules, regulations and orders of governmental and public bodies and agencies (not requiring structural repairs unless due to Tenant's particular use of the Premises)agencies, such as but not limited to the XxxxxxxxAmericans with Disabilities Act of 1990 and the Williams-Xxxxxxx Steiger Occupational Safety and Health Xxxxxx xxx Xxxxxh Act). If replacement of equipment, fixtures and appurtenances thereto is necessary, Tenant shall replace the same with new or completely reconditioned equipment, fixtures and appurtenances, and repair all damages done in or by such replacement. If Tenant fails to perform its obligations hereunder, Landlord without notice may, but shall not be obligated to, perform Tenant's obligations or perform work resulting from Tenant's acts, actions or omissions and add the cost of the same to the next installment of Minimum Monthly Rent due hereunder to be repaid in fullhereunder.
