Common use of Lunch and Rest Breaks Clause in Contracts

Lunch and Rest Breaks. 8.3.1 A Unit Member whose work day consists of six (6) hours or more shall have a duty- free unpaid lunch period of not less than thirty (30) minutes and not more than sixty (60) minutes per day. A six (6) hour instructional-setting Unit Member who does not receive a fifteen (15) minute break due to program needs, may, when pre-approved by their immediate supervisor, add fifteen (15) minutes to their lunch break. The duration of the lunch break shall be determined by the Employer, or his/her designee, based on the Unit Member’s assignment. When applicable, said lunch period shall be assigned by the Unit Member’s Department Head at approximately halfway through the Unit Member’s assigned work day.
