LOWER-TIER SUBCONTRACTS. (a) If, at any time during the progress of the work under this subcontract, Buyer determines that any lower-tier subcontractor’s performance is unacceptable for any reason, Xxxxx will notify the Subcontractor accordingly. The Subcontractor shall then take immediate steps to address the unsatisfactory performance up to and including termination of the lower-tier subcontract.
