Common use of Lottery Clause in Contracts

Lottery. In the event two or more employees have the same seniority ranking after the application of 1, 2, and 3, above, all employees so affected shall participate in a drawing, by lot, to determine ranking on the seniority list. The Association and all employees so affected shall be notified in writing, of the date, place, and time of the drawing. The drawing shall be conducted openly and at a time and place which will allow affected employees and the Association to be in attendance. This step shall be deemed final and binding.
