Lost and Unaccounted For Gas. Gatherer will conduct the services required to be performed by Gatherer under this Agreement using practices, methods and acts which are engaged in or which have been approved by a significant portion of the natural gas gathering industry. Producers acknowledge, however, that certain volumetric losses in Producers’ Gas and MV Mitigation Gas will occur even if such services are conducted in accordance with the preceding sentence, and such losses attributable to Lost and Unaccounted for Gas shall be shared and allocated among Producers and other third party shippers on each Xxxxxxx Gathering System in the proportion that each party delivers Gas to that Xxxxxxx Gathering System. Producers’ allocated share of Lost and Unaccounted for Gas on the Xxxxxxx Gathering Systems shall be based on actual losses on the Xxxxxxx Gathering Systems and shall not be subject to any minimum or maximum limits.

Lost and Unaccounted For Gas. Actual Lost and Unaccounted For Gas allocated to Shipper’s Gas, up to a maximum of [***] percent ([***]%) in any Accounting Period, shall be deducted in-kind from the quantity of Gas received from Shipper at the Receipt Points. Gatherer shall retain any Condensate condensed and collected in the Gathering System. If Gatherer does not have sufficient quantities of Gas available to supply in-kind Gas to Shipper if the L&U exceeds the cap provided in this Section 7.4 for a particular Accounting Period, then Gatherer shall pay to Shipper an amount equal to the product of the (i) volume of Gas in excess of the cap and the (ii) applicable Index Price with respect to such volume of Gas in excess of the cap provided hereunder.

Lost and Unaccounted For Gas. With respect to each Month and each of the Sweet Gas Gathering System and the Sour Gas Gathering System, FL&U less Field Fuel; provided, however, for each Month, Lost and Unaccounted for Gas shall be limited to the product of (i) the Quantity of Gas received into such system during such Month and (ii) the lesser of (a) one and one-half percent (1.5%) or (b) two hundred percent (200%) of the average L&U Percentage for such system for the twelve (12) Months immediately preceding such Month.
