Loser Pays. Each side agrees to pay the other side's costs of bringing any successful Lawsuit or collecting payment owed under this agreement.
Loser Pays. To the extent that an arbitrator determines that a member has failed to prevail in an arbitration under this Section 28, the arbitrator shall to that extent allocate to that member the costs of the arbitration, including reasonable attorneys’ fees and fees payable to the arbitrator.

With respect to any dispute among the parties arising out of or relating to this Agreement or the Participation Agreement, the reasonable attorneys’ fees and costs incurred by the prevailing party in connection with such dispute shall be paid by the other party or parties to such dispute.

In the event either Party brings suit against the other asserting claims arising out of or relating to this Agreement, the Incentive Grant Agreement, or the Side Agreement, the Parties agree that the prevailing party in that suit shall be entitled to reimbursement of all fees and costs by the non-prevailing party, including reasonable attorneys’ fees, incurred in defending or prosecuting that suit.
Loser Pays. In the event either party initiates (“claimant”) a lawsuit against the other party (“claimee”) claiming a breach or potential breach of this Lease and the claimee is found not to have breached this Lease, the claimant shall pay the costs and expenses (including reasonable attorney’s fees) of the claimee in defending such lawsuit.
