Lodge Rights. This Agreement does not create or convey to any member of the bargaining unit a right to determine whether any grievance shall be advanced to arbitration. The right to evaluate any grievance and determine whether that grievance is withdrawn, settled or advanced to any form of arbitration remains solely the right of the Lodge. In the event the Lodge determines it will not advance any grievance(s) to arbitration, the Officer(s) who filed the grievance(s) will be afforded the existing procedures for the review and/or challenge of reprimands or recommendations of discipline, to the extent provided for herein.

Lodge Rights. A. The Township agrees to grant time off, as provided by State Statute, to any employee designated by the Lodge to attend State and international meetings or conventions, provided seventy-two (72) hours written notice is given to the Chief of the Department by the Lodge. No more than two (2) employees from both units, that is, a total of two (2), shall be granted time off at any one time, unless an employee of the Township of Xxxxxxxx is elected as an officer in the State and/or National organization. In such cases, one such elected State- wide officer may be granted time off in addition to the two (2) representatives stated above. In addition, one other member from both units, that is, a total of one, shall be granted time off under the provisions of this paragraph to attend the annual meeting of the National Lodge of the Fraternal Order of Police.
Lodge Rights. A. The Borough agrees to grant time off without loss of pay to one (1) officer in the bargaining unit to attend state or national meetings or conventions, except in the event of any emergencies in accordance with the New Jersey State Law. A minimum of seventy-two (72) hours written notice of attendance of such meetings shall be provided to the Chief of Police by the Lodge.

  • SET-OFF RIGHTS The State shall have all of its common law, equitable and statutory rights of set-off. These rights shall include, but not be limited to, the State's option to withhold for the purposes of set-off any moneys due to the Contractor under this contract up to any amounts due and owing to the State with regard to this contract, any other contract with any State department or agency, including any contract for a term commencing prior to the term of this contract, plus any amounts due and owing to the State for any other reason including, without limitation, tax delinquencies, fee delinquencies or monetary penalties relative thereto. The State shall exercise its set-off rights in accordance with normal State practices including, in cases of set-off pursuant to an audit, the finalization of such audit by the State agency, its representatives, or the State Comptroller.

  • CSEA Rights CSEA shall have the following rights in addition to the rights contained in any other portion of this Agreement.

  • Exercise of access rights In exercising its access rights under clause 11.1, the Distributor must, except to the extent that the Distributor has any other binding agreement setting out its access rights directly with the Customer:

  • License Rights The Recipient must provide a license to its “subject data” to the Federal Government, which license is: (a) Royalty-free, (b) Non-exclusive, and (c) Irrevocable, (2) Uses. The Federal Government’s license must permit the Federal Government to take the following actions provided those actions are taken for Federal Government purposes: (a) Reproduce the subject data, (b) Publish the subject data, (c) Otherwise use the subject data, and (d) Permit other entities or individuals to use the subject data, and

  • Enforcement of Rights Borrowers are jointly and severally liable for the Obligations and Bank may proceed against one or more of the Borrowers to enforce the Obligations without waiving its right to proceed against any of the other Borrowers.

  • Leave Rights The parental leave shall begin at any time between a) the commencement of pregnancy or, in the event of adoption, the receipt of custody; and b) six (6) months after the child is born or adopted. Such leave shall be for any period up to one (1) school year, but shall be extended for up to one (1) additional school year at the request of the teacher. A mother or father may use any accumulated sick leave following the birth of a child. For complications during or after the birth of a child that may require extended leave, the mother and/or father may apply for use of the Sick Leave Bank under the provisions of this Agreement.

  • Step-In Rights If the Contractor is in material breach of its obligation to perform any of the services under the Contract and fails to remedy such breach within ten (10) days after written notice of the breach from the Department, the Department, at its sole discretion, shall have the right to “step-in” (i.e. perform the work itself) or hire another contractor to perform these services. Contractor shall be liable to the Department for any fees or expenses that the Department may incur in exercising its step-in rights or securing a substitute provider to assume completion of those services.
