Common use of Lists of Holders of Securities Clause in Contracts

Lists of Holders of Securities. (a) Each of the Sponsor and the Administrative Trustees on behalf of the Trust shall provide the Property Trustee at any time when the Property Trustee is not also acting as Security Registrar for the Securities (i) except while the Trust Preferred Securities are represented by one or more Global Securities, at least five Business Days prior to the date for payment of Distributions, a list, in such form as the Property Trustee may reasonably require, of the names and addresses of the Holders of the Securities ("List of Holders") as of the record date relating to the payment of such Distributions, and (ii) at any other time, within 30 days of receipt by the Trust of a written request from the Property Trustee for a List of Holders, as of a date no more than 15 days before such List of Holders is given to the Property Trustee; provided that neither the Sponsor nor the Administrative Trustees on behalf of the Trust shall be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Property Trustee by the Sponsor and the Administrative Trustees on behalf of the Trust. The Property Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in Lists of Holders given to it or which it receives in the capacity as Paying Agent (if acting in such capacity), provided that the Property Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) Each of the Sponsor and the Administrative Regular Trustees on behalf of the Trust shall provide the Property Trustee at any time when the Property Trustee is not also acting as Security Registrar for the Securities (i) except while the Trust Preferred Securities are represented by one or more Global Securitiessemiannually, at least five Business Days prior to the date for payment not later than March 31 and September 30 of Distributionseach year, a list, in such form as the Property Trustee may reasonably require, of the names and addresses of the Holders of the Securities ("List of Holders") as of the record a date relating not more than 15 days prior to the payment of such Distributionsdelivery thereof, and (ii) at any other time, time within 30 days of receipt by the Trust of a written request from the Property Trustee for a List of Holders, Holders as of a date no more than 15 days before such List of Holders is given to the Property Preferred Guarantee Trustee; provided provided, however, that neither the Sponsor nor the Administrative Regular Trustees on behalf of the Trust shall be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Property Trustee by or on behalf of the Sponsor and the Administrative Regular Trustees on behalf of the Trust, and in the absence of the provision of any such List of Holders to the Property Trustee, then notice shall be deemed to have been given to the Property Trustee that the List of Holders has not changed since the most recent List of Holders. The Property Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in Lists of Holders given to it or which it receives in the capacity as Registrar or Paying Agent (if acting in such capacity), provided provided, however, that the Property Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.

(a) Each of the Sponsor and the Administrative Regular Trustees on behalf of the Trust shall provide the Property Institutional Trustee at any time when the Property Trustee is not also acting as Security Registrar for the Securities (i) except while the Trust Preferred Securities are represented by one or more Global Securities, at least five Business Days prior to the within 14 days after each record date for payment of Distributions, a list, in such form as the Property Institutional Trustee may reasonably require, of the names and addresses of the Holders of the Securities ("List of HoldersLIST OF HOLDERS") as of the such record date relating to the payment of such Distributionsdate, and (ii) at any other time, within 30 days of receipt by the Trust of a written request from the Property Trustee for a List of Holders, as of a date no more than 15 days before such List of Holders is given to the Property Trustee; provided that neither the Sponsor nor the Administrative Regular Trustees on behalf of the Trust shall be obligated to provide such List of Holders at any time the List of Holders does not differ from the most recent List of Holders given to the Property Institutional Trustee by the Sponsor and the Administrative Regular Trustees on behalf of the TrustTrust and (ii) at any other time, within 30 days of receipt by the Trust of a written request for a List of Holders as of a date no more than 15 days before such List of Holders is given to the Institutional Trustee. The Property Institutional Trustee shall preserve, in as current a form as is reasonably practicable, all information contained in the Lists of Holders given to it or which it receives in the its capacity as Paying Agent (if acting in such capacity), provided that the Property Institutional Trustee may destroy any List of Holders previously given to it on receipt of a new List of Holders.
