The Services shall not be construed as a recommendation to perform any specific repair or maintenance (as that term is defined in applicable regulations), a determination of an engine's airworthiness, or a definitive diagnosis of engine condition. Client understands and acknowledges that such recommendations, determinations and definitive diagnoses can be made only by a qualified aviation maintenance technician after examining the physical engine and its maintenance records, and cannot be made based solely upon a review of the Engine Data such as that undertaken by Savvy in performance of the Services. Client further understands and acknowledges that Engine Data furnished by Client may contain inaccuracies, and in such cases Savvy is not responsible for erroneous interpretations or probable diagnoses.
Limitations of Services. We reserve the right to restrict or close your account for the following reasons (but not limited to): (i) we believe that we may suffer a loss if the account is not closed (ii) the volume of account activity exceeds that which we can reasonably and safely process including excessive Reg D transactions (iii) the activity exceeds what is deemed reasonable and consistent with the type of account (iv) we determine that any party related to the account or those claiming an interest in the account have been abusive in the use of the account or in the conduct of his or her affairs with us (v) we are unable to verify your identity in accordance with our Identification Policy (vi) we suspect fraudulent or suspicious activity (vii) you demonstrate negligence in protecting your password(s), PIN, checks, or other account authorization information (viii) you attempt to circumvent our policies and procedures (ix) you refuse to provide information and/or documentation needed to facilitate a transaction or service (x) your balance remains below Par value ($25.00) required minimum for six months (xi) you incur excessive overdrafts, returned unpaid items, or returned payments or deposits (xii) a change in account ownership or a change with regard to the persons authorized to sign on the account has occurred. What this means to you as a member is that we reserve the right to determine if certain activity on the account is within the scope of “usual or customary.” We reserve the right to question account owners to our satisfaction and our decisions will be final. You further understand and agree that we will impose restrictions, as described below, if you are delinquent or in default on any loan or other financial obligation owed to us. The availability to use electronic fund transfers via a debit card, Online Banking, Mobile or Text Banking is subject to restrictions as well. Our service provider may publish summary or aggregate results relating to metrics comprised of research data, from time to time, and distribute or license such anonymous aggregated research data for any purpose, including but not limited to, helping to improve products and services and assisting in troubleshooting and technical support. In respect to the SavvyAnalysis Pro Packs service, Xxxxx agrees to provide the Services to Client for the Aircraft from the date upon which Xxxxx has received electronic notification of Client’s intention to be bound by the terms of this Agreement (“Start Date”) to the earlier of (a) two years after the Start Date, and (b) the date on which Xxxxx has performed all of the data analysis services included in Client’s SavvAnalysis ProPacks subscription.

Notwithstanding any other provision of this User Agreement, use of data collected through your use of the Services for marketing and marketing program activities may include targeted marketing, meaning that specific marketing activities may be directed to a group of users, where each user meets certain pre-defined categories or characteristics. For example, a targeting marketing activity may issue a display ad for a group of users, where each user is identified as having an open credit card account through a financial institution.
Limitations of Services. We may limit the type, frequency, and dollar amount of transfer or transactions for security purposes and may change or impose the limits without notice, at our option. We reserve the right to modify such limits from time to time. If we permit you to conduct a transaction in excess of the established limits, such transaction will still be subject to the terms of this Agreement, and we will not be obligated to allow such a transaction at other times. We reserve the right to change from time to time the dollar amount of transfers you are permitted to make using the Transfer Service. In the event that your use of the Service has been suspended and reinstated, you understand and agree that your use of the Service thereafter may be subject to lower dollar amount limitations than would otherwise be permitted by us. All transfer limits are subject to temporary reductions to protect the security of customer accounts and/or the Service. Your limits may vary from those of other Members, depending upon criteria we establish from time to time.
