Common use of Limitation on Release Clause in Contracts

Limitation on Release. The foregoing provision with respect to the release to the Servicer of the Required Loan Documents and documents by the Collateral Custodian upon request by the Servicer shall be operative only to the extent that the Administrative Agent has consented to such release. Promptly after delivery to the Collateral Custodian of any request for release of documents, the Servicer shall provide notice of the same to the Administrative Agent. Any additional Required Loan Documents or documents requested to be released by the Servicer may be released only upon written authorization of the Administrative Agent. The limitations of this paragraph shall not apply to the release of Required Loan Documents to the Servicer pursuant to the immediately succeeding subsection.

Promptly after delivery Custodian shall not have released to the Collateral Custodian of any request for release of documents, Manager active Required Loan Documents (including those requested) pertaining to more than 15 Loans at the Servicer shall provide notice of time being serviced by the same to the Administrative AgentCollateral Manager under this Agreement. Any additional Required Loan Documents or documents requested to be released by the Servicer Collateral Manager may be released only upon written authorization of the Administrative Agent. The limitations of this paragraph shall not apply to the release of Required Loan Documents to the Servicer Collateral Manager pursuant to the immediately succeeding subsection.

Promptly after delivery to the Collateral Custodian or the Collateral Administrator, as applicable, of any request for release of documents, the Servicer shall provide notice of the same to the Administrative Agent. Any additional Required Loan Documents or documents requested to be released by the Servicer may be released only upon written authorization consent of the Administrative AgentAgent (such consent not to be unreasonably withheld or delayed). The limitations of this paragraph shall not apply to the release of Required Loan Documents to the Servicer pursuant to the immediately succeeding subsection.

Any additional Required Loan Documents or documents requested to be released by the Servicer Collateral Manager may be released only upon written authorization of the Administrative Agent. The limitations of this paragraph shall not apply to the release of Required Loan Documents to the Servicer Collateral Manager pursuant to the immediately succeeding subsection.

The limitations of this paragraph shall not apply to the release of Required Loan Documents to the Servicer pursuant to the immediately succeeding subsection.

Promptly after delivery to the Collateral Custodian of any request for release of documents, the Servicer Borrower shall provide notice of the same to the Administrative Agent. Any additional Required Loan Documents or documents requested to be released by the Servicer Borrower may be released only upon written authorization of the Administrative Agent. The limitations of this paragraph shall not apply to the release of Required Loan Documents to the Servicer Borrower pursuant to the immediately succeeding subsection.. 128

Limitation on Release. The foregoing provision with respect to the release to the Servicer Portfolio Manager of the Required Loan Documents and documents by the Collateral Custodian upon request by the Servicer Portfolio Manager shall be operative only to the extent that the Administrative Agent has consented to such release. Promptly after delivery to the Collateral Custodian of any request for release of documents, the Servicer Portfolio Manager shall provide notice of the same to the Administrative Agent. Any additional Required Loan Documents or documents requested to be released by the Servicer Portfolio Manager may be released only upon written authorization of the Administrative Agent. The limitations of this paragraph shall not apply to the release of Required Loan Documents to the Servicer Portfolio Manager pursuant to the immediately succeeding subsection.
