Limitation on Access. If either party is given access, whether -------------------- on-site or through remote facilities, to any computer or electronic data storage system of the other party in order to accomplish the Services called for in this Agreement, the party that receives such access shall limit such access and use solely to perform Services within the scope of this Agreement and shall not access or attempt to access any computer system, electronic file, software or other electronic services other than those specifically required to accomplish the Services required under this Agreement. Under no circumstances shall either party's personnel access any networks or facilities of the other party for the purpose of accessing other external networks, nor shall any such capabilities for such access be published or made known via any medium, as for example and not by way of limitation, posting on bulletin boards or E-mail. Any such use or publication shall be a material breach of this Agreement. Neither party shall use back doors, data capture routines, games, viruses, worms, or Trojan horses and any intentional introduction of such into the other party's data networks shall be deemed a material breach of this Agreement. The party receiving access shall limit such access to those of its employees whom the other party has authorized in writing to have such access in connection with this Agreement or the applicable Statement of Work, and shall strictly follow all security rules and procedures for use of the providing party's electronic resources. All user identification numbers and passwords and any information obtained as a result of access to and use of a party's computer and electronic data storage systems shall be deemed to be, and shall be treated as, Confidential Information under applicable provisions of this Agreement. Each party agrees to cooperate with the other in the investigation of any apparent unauthorized access to a party's computer or electronic data storage systems.
Limitation on Access. Nothing in this Lease shall be construed to permit Lessee or its representatives to have access to any files, records, contracts or documents of Lessor or any Affiliate of Lessor relating to (i) Lessor's or any of its Affiliate's inter-company or intra-company feedstock and product pricing information, internal transfer prices, hedging activity records and hydrocarbon inventory valuation procedures and records or (ii) this transaction.
Limitation on Access. Notwithstanding anything to the contrary contained in this Section 3.05, if Purchaser and one or both of the Sellers are in an adversarial relationship in connection with any pending or threatened litigation or arbitration arising under or related to this Agreement, the APX Purchase Agreement or any of the Operative Agreements, the furnishing of books, records and other documents and information in accordance with paragraph (b) above shall be subject to applicable rules relating to discovery.

SHOPPING PLANET agrees to permit access to the Technology by only those employees with a need to have access and will cause such employees and/or consultants who are permitted access to sign a confidentiality agreement in a form which includes the degree of care that NETGATEWAY utilizes to protect its own confidential information of similar nature which shall be no less than a reasonable degree of care.

Limitation on Access. Your access and use of the APIs is free. However, there is a rate limit and restriction in the usage of the APIs, and you agree that you shall comply with that rate limit and restrictions at all times. The basic rate limit is one call per second. If you need more calls or a higher limit, simply email us at xxxx@xxxxxxxxx.xxx and tell us what you need and we may increase your limit. We may require a fee to cover our costs for any increase in the basic rate limit, and will provide that information to you in response to your request. Our rate limits and restrictions are subject to change from time to time in our sole discretion, effective immediately upon our posting such change on our website.
Limitation on Access. During the Construction Period, YMCA may permit others to use, occupy, or enter upon the Leased Area and the Construction Use Area only for purposes in furtherance of construction of the YMCA Facility. Such personnel includes, without limitation, contractors, subcontractors, engineers, architects, County officials, inspectors, State officials, and their agents, servants, or employees.
Limitation on Access. Each User shall use the Service only through (i) the Software, (ii) the Web Site (if any), or (iii) one tablet or mobile device. User shall not copy, download, or create a mirror of any component of the Service, or use the Service on more than one tablet or mobile device simultaneously.
