Limitation of Use. The parties agree that this Agreement shall not be proffered by either party in another jurisdiction as evidence of any concession or as a waiver of any position taken by the other party in that jurisdiction or for any other purpose.
Limitation of Use. 1. The content and information on the Website and/or Application, as well as the infrastructure used to provide such content and information, is proprietary to Us or Our licensor. Limitation of Use. Renter agrees that the number of persons shall not exceed the capacity of the room rented (see reverse side) and that no intoxicating liquor or fermented malt beverages shall be served to minors. In the event this Limitation of Use is not complied with, renter shall be charged and agrees to pay an additional rental fee of $200.
Limitation of Use. 68 The Parties hereby agree that any Confidential Information received shall only be used by the Receiving Party for purposes 69 of review, analysis and determination of the feasibility of a contemplated real estate transaction involving the Parties and 70 shall not be used for any other purpose. Limitation of Use. The Contracting Parties undertake to use the disclosed confidential INFORMATION only for evaluation of a potential academic and/or commercial use. The Receiving Party shall make no use, in whole or in part, of any such Proprietary Information other than in furtherance of the purpose of this Agreement without the prior written consent of the Disclosing Party. If the purpose of the information exchange is the preparation of a proposal to the United States Government, Proprietary Information of either party may be incorporated into the proposal to the United States Government, provided that the proposal document bears the restrictive legend contained in Federal Acquisition Regulation 52.215-12 or a substantially similar successor provision. TERM: This Agreement shall expire one (1) year from the date recited in the first paragraph of this Agreement. With the exception of information disclosed in accordance with the provisions of the License Agreement for Detector between Digirad Corporation and the Regents of the University of California through the Xxxxxx Xxxxxxx Xxxxxxxx Berkeley Laboratory, immediately upon a request by the Disclosing Party at any time (which will be effective if actually received or three days after mailed first class postage prepaid to the Receiving Party's address herein), the Receiving Party will turn over to the Disclosing Party all Proprietary Information of the Disclosing Party and all documents or media containing any such Proprietary Information and any and all copies or extracts thereof. Operator agrees that, except as otherwise directed or approved in writing by Delta, in Delta’s sole discretion, (1) the Aircraft may be used only to provide the air services contemplated by this Agreement (including charter flights pursuant to Section 1F hereof, the “Delta Connection Flights”), (2) the Delta Connection Flights shall only be operated under Delta’s “DL” flight designator code except as otherwise directed by Delta, and (3) the Aircraft may not be used by Operator for any other purpose including, without limitation, flying for any other airline, providing charter services other than pursuant to Section 1F hereof, or on Operator’s own behalf.
