License upon Termination or Default. If this Agreement is terminated prior to completion of the Project, the license granted under Section 2.10.1 shall automatically terminate and be replaced by a license to use the Work product and Construction Documents to complete the Project and subsequently occupy, operate, maintain and repair the Project, provided that if Project Manager is not then in default under this Agreement, Owner shall pay all amounts then due and payable though the date of termination to Project Manager.
