Liability Period. Customer’s claims for damages against PTC and/or PTC’s affiliates, regardless of the legal grounds, shall expire at the latest one year from the time the Customer gains knowledge of the damage or, irrespective of this knowledge, at the latest two years after the damaging event. For claims based on Errors of the Licensed Product(s), the warranty limitation period pursuant to Section 4.2 shall apply.
Liability Period. The Beneficiary may not commence any legal action against the Consultant under this agreement after 12 years from the date of practical completion of the Consultant’s Services.
Liability Period. 10.1Unless stated otherwise in this Contract, the Defects Liability Period will commence at the day of completion of all of the Works or delivery of the Goods and will continue for a period of eighteen (18) months thereafter.
Liability Period. The liability period, in respect of sickness or accidental injury, is unlimited up to and including the end of the month in which the insured attains the age of 67 unless otherwise indicated by the group scheme agreement. It is a precondition that the insurance is in force. If the insurance has expired, the liability period and consequently the cover cease to apply.
Liability Period. 9.1 No legal action may commence under this agreement after 12 years from the earlier of: (1) termination of the Sub-Contract; and (2) completion of the Beneficiary’s works in relation to the Project.
Liability Period. Neither party shall commence any legal action against the other under this appointment after six years from the date of making good of defects of all of the Project and any adjudicator’s decision under Paragraph 12 of this appointment shall be finally binding on both of us unless either party has referred that dispute for final determination by legal proceedings, or has commenced any legal action to recover any overpayment to which the decision has led, before that date.
Liability Period. Subject to clause 7.4, the Defects Liability Period stated in item 8) of Schedule A shall commence at the time and for the period specified in item 8) of Schedule A.
Liability Period. The Beneficiary may not commence any legal action against the Sub-Contractor under this agreement after [six OR 12] years from the date of [practical completion OR making good of defects] of all of the Works.
Liability Period. Liability period shall be as follows: · Liability period for breach of Fundamental Warranties and Tax Warranties shall terminate 5 (five) years after the Closing Date. · Liability period for breach of Business Warranties shall terminate 2 (two) years after the Closing Date.
Liability Period. The Employer may not commence any legal action against the Contractor under this agreement after six (6) years from the date of this Agreement.
