Liability of the Fund. The Fund and the Custodian agree that the obligations of the Fund under this Agreement shall not be binding upon any of the Directors, Trustees, shareholders, nominees, officers, employees or agents, whether past, present or future, of the Fund individually, but are binding only upon the assets and property of the Fund.

The Platform Manager understands and agrees that the obligations of the Fund under this Agreement are not binding upon any shareholder, or any person serving on the Board, personally, but bind only the Fund and the Fund’s property. The Platform Manager represents that it has notice of the provisions of the Trust Instrument, as amended, disclaiming shareholder and Trustee liability for acts and obligations of the Fund.

The Service Agent understands and agrees that the obligations of the Fund under this Agreement are not binding upon any Member or any person serving on the Board (a "Manager") personally, but bind only the Fund and the Fund's property. The Service Agent represents that it has notice of the provisions of the Fund's Limited Liability Agreement disclaiming Member and Manager liability for acts and obligations of the Fund.

The Firm represents that it has notice of the provisions of the Fund's Limited Liability Company Agreement disclaiming Member and Board liability for acts and obligations of the Fund. The Firm understands and agrees that the Fund's obligations under this Agreement are not binding upon any Member or any person serving on the Board personally, but bind only the Fund and the Fund's property. Any rights or causes of action will be directed to the parties in this Agreement.
