Level IV - Board of Education. 15.3.5.1 The Board has the right and responsibility for making a final decision regarding a grievance.

Level IV - Board of Education. (1) If the grievant and the Association Committee are not satisfied with the decision at Level El, the grievant and the Association Committee will file an appeal in writing with the Board within five (5) school days after receiving the decision at Level HI. The written grievance and the written decisions at Levels II and HI shall be available for use of the Board and the grievant or the Association Committee.
Level IV - Board of Education. If the aggrieved is not satisfied with the suggestion for resolution received in Level III, he/she may within five (5) days of receipt of such written response, submit his/her written grievance to the Board of Education and request a meeting to discuss the grievance. The meeting date shall be set within five (5) days of the request, not to exceed the next regular meeting date. The meeting shall be conducted in executive session in a manner as stated in Level II. Within five (5) days of the meeting, the Board shall provide the aggrieved with a written response stating their position and resolution of the grievance. The Board President and the Association President may waive Level IV by written mutual consent executed within the time limits for setting the meeting date. The grievant may then advance the grievance to Level V - Arbitration.

The Board shall consider the grievance in closed session. The grievant and/or grievant’s representative may present written or oral argument to the Board during the closed session. The Board shall consider only those evidentiary materials that have been presented at prior levels. The decision of the Board as to the disposition of the grievance shall be final.

The Board's representative shall submit the grievance to the Board if the grievance is not resolved, and within fifteen (15) school days the Board shall arrange and meet with the aggrieved member for the purpose of adjusting or resolving the grievance. The Board shall hear and act upon the grievance and render a decision within five (5) days.
