Lender Inspections. Lender, or any of its Agents or Representatives, shall have the right to reasonably inspect the Mortgaged Property upon reasonable notice. Should the Mortgaged Property, or any part thereof, require repair, care or attention, then, after written notice as provided herein (Paragraph 16) to Borrower, and Borrower's failure to so perform, Lender may enter or cause entry to be made upon the Mortgaged Property and repair, protect and maintain the property as Lender may deem necessary. Any and all money that Xxxxxx must pay to accomplish the proper maintenance on the mortgaged property shall become due and payable under the provision of Paragraph 10.

Lender Inspections. Throughout the term of the Loan, Borrower will permit Lender and Lender's representatives, inspectors and consultants to audit, examine and copy all contracts and records (including, but not limited to, financial and accounting records pertaining to the Loan) and to discuss the affairs, finances and accounts of Borrower with representatives of Borrower;
Lender Inspections. Upon reasonable prior notice, throughout the term of the Loan and during normal business hours, Borrower shall permit Lender or Collateral Agent and Lender’s or Collateral Agent’s representatives, inspectors, and consultants to enter upon the premises where any Collateral may be located and inspect the Collateral, to audit, examine, and copy all contracts, records (including, but not limited to, financial and accounting records pertaining to the Loan or the Collateral) which are kept at such premises or at Borrower’s offices, and to discuss the affairs, finances, and accounts of Borrower with representatives of Borrower and, to the extent Borrower is able, will cause others to provide access to Lender or Collateral Agent and Lender’s or Collateral Agent’s representatives, inspectors, and consultants to audit, examine, and copy all contracts, books, documents and records.
Lender Inspections. At any time that any material Capital Expenditure individually in excess of $100,000 is being incurred during the Term, during normal business hours, Borrower shall permit Lender and Lender's representatives, inspectors and consultants to enter upon the Real Property, to inspect any construction and materials to be used therein and to examine all contracts, records, plans and shop drawings which are kept at the construction site or at Borrower's offices. Lender shall keep confidential the information obtained from such inspections, provided Lender shall be permitted to disclose such information to its attorneys, accountants and advisors who agree to maintain the confidentiality of such information, and shall also be permitted to disclose such information as may be necessary or appropriate in any public filing of the Company or GTA, Inc. or in any litigation proceedings.
Lender Inspections. During normal business hours and, in the event of an emergency, at any time, Borrower shall permit Lender and Lender's representatives, inspectors and consultants to (a) enter upon the Facilities, (b) inspect the Facilities, and (c) examine all contracts, books and records relating to Borrower's operations at the Facilities, and make copies of any such items at Lender's expense.
Lender Inspections. Lender, the Independent Construction Consultant and their respective officers, employees, agents and representatives (the "Inspecting Parties") shall have the right at any time to enter the site of the Project and inspect the work of construction and all materials, plans, specifications and other matters relating to the Project or the construction thereof. From time to time, at the Contracting Party's place of business during customary business hours and upon reasonable prior notice, the Inspecting Parties shall also have the right to examine, copy and audit the books, records and accounting data and other documents of the Contracting Party relating to the Project. Any inspection of the Project by Lender or any examination, acceptance or approval by Lender of documents relating to the Project, including, but not limited to, plans, specifications, books, records and vouchers, is for the sole purpose of protecting Lender's rights under the Disbursement Agreement and the other Collateral Documents and its security for the Obligations. The Contracting Party shall not rely on any such inspection, examination, acceptance or approval by Lender. In no event shall the Inspecting Parties be obligated to disclose to the Contracting Party or to the Company the results of any such inspection or examination.

Lender Inspections. During normal business hours, Borrower shall permit Lender and Lender's representatives, inspectors and consultants to enter upon the Project premises to inspect the Project and materials to be used therein and to examine all of Borrower's contracts, records, plans and shop drawings which are kept at the construction site or at Borrower's offices. Lender shall use reasonable efforts to give Borrower prior written notice of all such inspections, except after the occurrence and during the continuation of a Default or Event of Default. Borrower shall cooperate, and shall employ commercially reasonable efforts to cause its general contractor, other independent contractors and/or Construction Manager and (through its general contractor, other independent contractors and/or Construction Manager or otherwise) all subcontractors to cooperate, with all such representatives, inspectors and consultants. Borrower shall cause the general contractor, other independent contractors and/or Construction Manager to maintain and make available for inspection by Lender and Lender's representatives, inspectors and consultants, on demand, all documents and materials created and maintained in the ordinary course of business in connection with the Project.

Borrower will cooperate with and shall cause the General Contractor, Construction Contractors and Subcontractors to cooperate with any such representatives, inspectors or consultants retained by Lender pursuant to Section 8.9 to enable them to perform their functions under this Agreement. Borrower will have the General Contractor maintain and make available for inspection by Lender or its representatives on demand, daily log sheets covering the period since the immediately preceding inspection, which log sheets shall show dates, weather conditions, number of workers, Construction Contractors and Subcontractors on the job and the progress of construction.
