Legal Education. Ensure staff members use a System Agency approved competency training module to provide legal education for each Program participant. Submission of the System Agency approved competency training module is due September 1st of each state fiscal year.
Legal Education. Although the Mediator is a lawyer, he is not acting as a lawyer for either or both of them. The Mediator will use his general knowledge of the law to educate the Wife and Husband concerning the law as it generally applies to like situations, which in turn will assist them to negotiate an informed agreement. In the event that either party wishes to consult a lawyer at any time, including upon the completion of a final draft agreement, the party should feel more than free to do so and is under no obligation to disclose the advice, if any, received.
