Legal acts. 34.1 In accordance with Article 132 of the Treaty on the Functioning of the European Union, the ECB shall: — make regulations to the extent necessary to implement the tasks defined in Article 3.1, first indent, Articles 19.1, 22 or 25.2 and in cases which shall be laid down in the acts of the Council referred to in Article 41; — take decisions necessary for carrying out the tasks entrusted to the ESCB under these Treaties and this Statute; — make recommendations and deliver opinions.

Legal acts. The aim was to look for the most recent fundamental legal acts for inclusion in the inventory. This was done by searching the EUR-Lex website. 18 legal acts were found, of which 8 were considered to be fundamental (not implementing or amending existing legal acts) – see Annex B. All but one were classed in the statistical domain of “banking, insurance or financial statistics”. These 8 legal acts were assessed against the list of attributes and it was proposed that they were viable candidates for inclusion in the inventory. 5 of these 8 legal acts were “recasts” i.e. substantial amendments made to an existing legal act, causing the existing legal act to be repealed. The original legal acts have not yet been proposed to be included in the inventory so they do not need to be removed from the list. Of the remaining 9 non-fundamental (implementing or amending) legal acts and 1 “commission opinion”, 7 have already been proposed for inclusion in the inventory so these will need to be referred to in the "name of the connecting other NDs" section of the attributes list of their parent normative documents. The process to find these legal acts was straightforward due to the user friendly nature of the EUR- Lex website. The main difficulty was in understanding and interpreting these legal acts in order to complete the attributes template correctly. This will be less of a problem when the inventory is live as the attributes list will be completed by their custodians who understand the legal terminology. The EUR-Lex website was also slow to open documents and links. Completion of the templates has been independently quality assured.

  • Actions Each Lender hereby appoints National City as its Agent under and for purposes of this Agreement, the Notes and each other Loan Document. Each Lender authorizes the Agent to act on behalf of such Lender under this Agreement, the Notes and each other Loan Document and, in the absence of other written instructions from the Required Lenders received from time to time by the Agent (with respect to which the Agent agrees that it will comply, except as otherwise provided in this Section or as otherwise advised by counsel), to exercise such powers hereunder and thereunder as are specifically delegated to or required of the Agent by the terms hereof and thereof, together with such powers as may be reasonably incidental thereto. The Agent shall not be required to take any action hereunder, under the Notes or under any other Loan Document, or to prosecute or defend any suit in respect of this Agreement, the Notes or any other Loan Document, unless it is indemnified hereunder to its satisfaction. If any indemnity in favor of the Agent shall be or become, in the Agent’s determination, inadequate, the Agent may call for additional indemnification from the Lenders and cease to do the acts indemnified against hereunder until such additional indemnity is given.
