It is agreed that the term \u201cregional retail development\u201d as used herein shall mean and refer to the Anchor Store Sites and the Shopping Center, including the buildings located or to be located thereon, all as shown on the site plan which is set forth in Exhibit A attached hereto and made a part hereof, and that the term \u201cShopping Center\u201d shall, except as otherwise specifically provided herein, mean and refer to the hatched and the shaded portions of such site plan which portions from time to time open directly on the enclosed mall, if any, and which may vary at each level of the regional retail development, together with the enclosed mall, if any, (whether or not shaded or hatched). The approximate location of the Premises leased to Tenant hereunder is shown in Exhibit A. The leased premises (herein referred to as the \u201cLeased Premises\u201d or \u201cPremises\u201d) are described as set forth in the Data Sheet attached hereto. As used in this Lease, the term \u201cState\u201d shall mean the state or commonwealth in which the Shopping Center is located.\n(b) The exterior walls and the roof of the Leased Premises and the area beneath said Premises are not demised hereunder, and the use thereof, together with the right to locate, both vertically and horizontally, install, maintain, use, repair and replace pipes, utility lines, ducts, conduits, flues, refrigerant lines, drains, sprinkler mains and valves, access panels, wires and structural elements leading through the Leased Premises serving other parts of the regional retail development, is hereby reserved unto Landlord. Landlord reserves an easement in, over and through the area occupied by the storefront of the Leased Premises, and an easement above Tenant\u2019s finished ceiling to the roof, or to the bottom of the floor deck above the Leased Premises, for general access purposes and in connection with the exercise of Landlord\u2019s other rights under this Lease.\n(c) The attached site plan of the regional retail development, Exhibit A, includes premises identified thereon as Anchor Store Sites, including the buildings located or to be located thereon, which sites are collectively hereinafter referred to as the \u201cAnchor Store Site(s)\u201d and/or \u201cAnchor Store(s),\u201d unless otherwise specifically set forth. It is agreed that, wherever the term \u201cShopping Center\u201d is used herein, it shall be deemed to exclude the Anchor Store Sites (even if such Sites shall be within the hatched and/or shaded area shown on the site plan), except as otherwise specifically stated herein. In addition, said site plan includes other portions of the Shopping Center which Landlord may from time to time sell or lease for the purpose of construction and/or use by one or more anchor stores (as defined in Section 27.12 hereof), which portion(s) may thereupon, at Landlord\u2019s option, be referred to and treated as \u201cAnchor Store Site(s)\u201d and/or \u201cAnchor Store(s)\u201d upon occupancy thereof by an anchor store, and which, at Landlord\u2019s option, may be excluded from the Shopping Center. In the event Landlord elects to enlarge the regional retail development, any additional area may be included by Landlord in the definition of the Shopping Center for purposes of this Lease. Landlord shall also have the general right from time to time to include within and/or to exclude from the defined Shopping Center any existing or future areas, and the floor area of the Shopping Any damage caused by Tenant arising from or in any way caused by Tenant\u2019s use including installation of Equipment and Facilities shall be the sole responsibility of Tenant. As damage to one part of the Premises can impact the entire Bridge and such repairs may be subject to OSHA compliance, payment of prevailing wage, and other applicable requirements for work on public property, nothing in this Lease prevents Landlord from promptly making any repairs or taking other actions related to the Bridge, or causing the same to be done, and billing Tenant for the costs of such repairs and Tenant hereby agrees to reimburse Landlord for the same within thirty (30) days after receipt of an invoice for same.\n(c) A revocable installation permit (a \u201cPermit\u201d) shall be required for each and every installation of Tenant\u2019s Equipment and Facilities so that Landlord can review the proposed space of each such installation for compliance with this Lease, including compliance with Exhibit 2 and City Codes, compatibility with the Bridge, and authorization rights. Prior to installation of Tenant\u2019s Equipment and Facilities, Tenant shall apply for a Permit, on an application form provided by Landlord, and pay all applicable fees. The cost of such Permits shall be established by the Landlord in accordance with Section 510.070 of the City\u2019s Code, as may be hereinafter amended or recodified. A Permit application shall describe the space on the Bridge that Tenant proposes to attach to (including, specifically, the exact dimensions of the portions the Bridge proposed to be utilized), the method of attachment to the Bridge, the Equipment and Facilities proposed to be attached to the Bridge (with exact dimensions), and any other information that the Landlord determines is applicable within the Permit application documents. All permit requests shall be accompanied by a structural engineering analysis indicating that the work proposed in the Permit shall not effect the structural integrity of the Bridge, including any piers, joists, deck, or any other structural element of the Bridge. A Permit request shall be reviewed by the Landlord and may be denied at Landlord\u2019s sole discretion. A Permit granted shall be limited to the specific location upon the Bridge and Facilities and Equipment proposed by Tenant within the specific application. If Tenant shall need additional Equipment and Facilities upon the Bridge or additional space on the Bridge not specifically authorized in an issued Permit, Tenant shall submit for, and acquire, additional Permits prior to utilizing any additional space on the Bridge or installing additional Equipment or Facilities. Tenant shall have six (6) months from the issuance of a Permit to complete any installation work approved. Failure to complete such work within said timeframe shall result in that specific Permit being null and void.
