Common use of Lands of Other Property Owners Clause in Contracts

Lands of Other Property Owners. If any part of the Connecting Transmission Owner’s Attachment Facilities and/or System Upgrade Facilities and/or System Deliverability Upgrades is to be installed on property owned by persons other than Developer or Connecting Transmission Owner, the Connecting Transmission Owner shall at Developer’s expense use efforts, similar in nature and extent to those that it typically undertakes for its own or affiliated generation, including use of its eminent domain authority, and to the extent consistent with state law, to procure from such persons any rights of use, licenses, rights of way and easements that are necessary to construct, operate, maintain, test, inspect, replace or remove the Connecting Transmission Owner’s Attachment Facilities and/or System Upgrade Facilities and/or System Deliverability Upgrades upon such property.

Lands of Other Property Owners. If any part of the Connecting Transmission Owner’s Attachment Facilities Interconnection Facilities, Network Upgrades, and/or System Upgrade Facilities and/or System Deliverability Distribution Upgrades is to be installed on property owned by persons other than Developer Interconnection Customer or Connecting Transmission Owner, the Connecting Transmission Owner shall at DeveloperInterconnection Customer’s expense use efforts, similar in nature and extent to those that it typically undertakes for on its own behalf or affiliated generationon behalf of its Affiliates, including use of its eminent domain authorityauthority to the extent permitted and consistent with Applicable Laws and Regulations and, and to the extent consistent with state lawsuch Applicable Laws and Regulations, to procure from such persons any rights of use, licenses, rights of way and easements that are necessary to construct, operate, maintain, test, inspect, replace or remove the Connecting Transmission Owner’s Attachment Facilities Interconnection Facilities, Network Upgrades and/or System Upgrade Facilities and/or System Deliverability Distribution Upgrades upon such property.

If any part of the Connecting Transmission Owner’s Attachment Facilities and/or System Upgrade Facilities and/or System Deliverability Upgrades is to be installed on property owned by persons other than Developer or Connecting Transmission OwnerOwners, the Connecting Transmission Owner National Grid shall at Developer’s expense use efforts, similar in nature and extent to those that it typically undertakes for its own or affiliated generation, including use of its eminent domain authority, and to the extent consistent with state law, to procure from such persons any rights of use, licenses, rights of way and easements that are necessary to construct, operate, maintain, test, inspect, replace or remove the Connecting Transmission Owner’s Attachment Facilities and/or System Upgrade Facilities and/or System Deliverability Upgrades upon such property.

If any part of the Connecting Transmission OwnerProvider’s Attachment Interconnection Facilities and/or System Upgrade Facilities and/or System Deliverability Upgrades is to be installed on property owned by persons other than Developer Interconnection Customer or Connecting Transmission OwnerProvider, the Connecting Transmission Owner Provider shall at DeveloperInterconnection Customer’s expense use efforts, similar in nature and extent to those that it typically undertakes for on its own behalf or affiliated generationon behalf of its Affiliates, including use of its eminent domain authority, and to the extent consistent with Federal or state law, or the local regulatory authority, as applicable, to procure from such persons any rights of use, licenses, rights of way and easements that are necessary to construct, operate, maintain, test, inspect, replace or remove the Connecting Transmission OwnerProvider’s Attachment Interconnection Facilities and/or System Upgrade Facilities and/or System Deliverability Upgrades upon such property.
