Land Development Activities. Any time after the execution of this Agreement, and prior to approval of the Final Development Plan for any Neighborhood or other part of the Property, Owner may, at its own risk, undertake excavation, mass grading, erosion and sedimentation control, water retention and detention, filling, soil stockpiling and site grading (“Earthwork”) in and upon such Neighborhood or portion of the Property after having complied with the Village requirements.
