JURISDICTION/COSTS. 35.1 The Purchaser hereby consents in terms of Section 45 of the Magistrate's Courts Act, No. 32 of 1944, as amended, to the jurisdiction of any Magistrate's Court having jurisdiction over its person under Section 28 of that Act, notwithstanding that any action or proceeding arising out of this Agreement would otherwise be beyond the jurisdiction of such court. The Seller shall, however, have the right to institute action in any other court of competent jurisdiction.
JURISDICTION/COSTS. Litigation concerning this Agreement, if initiated by or on behalf of Employee, shall be brought only in a state court in Philadelphia County, Pennsylvania or federal court in the Eastern District of Pennsylvania, or, if initiated by the Company, in either such jurisdiction or (if different) in a jurisdiction in which Employee then resides or works. Employee consents to jurisdiction in any such jurisdiction, regardless of the location of Employee’s residence or place of business. Employee and the Company irrevocably waive any objection, including any objection to the laying of venue or based on the grounds of forum non conveniens, which Employee or the Company may now or hereafter have, to the bringing of any action or proceeding in any such jurisdiction. Employee and the Company acknowledge and agree that any service of legal process by mail constitutes proper legal service of process under applicable law in any such action or proceeding. In any such litigation, the prevailing party shall be entitled to reimbursement from the other party for all costs of defending or maintaining such action, including reasonable attorneys’ fees.
JURISDICTION/COSTS. Notwithstanding the amount which may at any time be owing by the buyer to the seller, the parties hereby consent in terms of section 45 of the Magistrates Court Act No 32 of 1944 as amended to the jurisdiction of the Magistrates Court having jurisdiction for the determination of any action or proceedings otherwise beyond the jurisdiction of the said Court which may be brought by the seller against the buyer arising out of any transaction between the parties, being recorded that the seller shall be entitled, but not obliged, to bring any action or by the buyer.
JURISDICTION/COSTS. Each of the parties hereto hereby irrevocably consents and submits to the exclusive jurisdiction of the state and federal courts located in Xxxx County, Tennessee in connection with any proceeding arising out of or relating to this Agreement or the transactions contemplated hereby and waives any objection to venue in Xxxx County, Tennessee. In addition, each of the parties hereto hereby waives trial by jury in connection with any claim or proceeding arising out of or relating to this Agreement or the transactions contemplated hereby. In the event of any legal proceeding (in arbitration, a court of law or otherwise) arises between the parties in respect of this Agreement, the substantially prevailing party under any final non-appealable award or judgment, will be entitled to recover from the other party hereto, in addition to any other relief awarded, all reasonable costs and expenses (including reasonable legal fees, costs and expenses) that the prevailing party incurs in connection with those proceedings.
JURISDICTION/COSTS. Each party irrevocably submits to the exclusive jurisdiction of the state and federal courts of proper subject matter jurisdiction in Xxxxxx County, Texas, United States of America, solely for the purpose of interpreting this Agreement and adjudicating any dispute arising hereunder. If any legal action or other proceeding is brought for the enforcement of any of the terms of this Agreement, the prevailing party will be entitled to recover reasonable attorneys’ fees and other costs incurred in the action or proceeding in addition to any other relief to which it may be entitled.
JURISDICTION/COSTS. The Purchaser hereby consents in terms of Section 45 of the Xxxxxxxxxxx' Xxxxx Xxx, Xx. 00 of 1944, as amended, to the jurisdiction over any person under Section 45 of that Act, notwithstanding that any action or proceeding arising out of this Agreement would otherwise be beyond the jurisdiction of such Court. The Seller shall, however, have the right to institute action in any other Court of competent jurisdiction. The Purchaser agrees that, in the event of the Seller instructing its attorneys and/or taking legal proceedings against the Purchaser pursuant to a failure by the Purchaser to fulfil any of its obligations in terms hereof, then the Purchaser shall pay all legal costs plus VAT incurred by the Seller in connection therewith as between attorney and own client, including collection commission laid down at the tariff rate applicable.
JURISDICTION/COSTS. We can bring any ac�on against you for a claim that may arise under this agreement in the Magistrate’s Court, even if the amount we claim from you exceeds the jurisdic�on of that Court. You will pay all our expenses in recovering any amounts you owe us, including legal costs on the a�orney and client scale, collec�on charges, tracing fees and VAT.

The PURCHASER hereby consents in terms of Section 45 of the Magistrate’s Court Act, No 32 of 1944, as amended, to the jurisdiction of any Magistrate’s Court having jurisdiction over its person under Section 28 of that Act, notwithstanding that any action or proceeding arising out of this Agreement would otherwise be beyond the jurisdiction of such court. The SELLER shall, however, have the right to institute action in any other court of competent jurisdiction.
JURISDICTION/COSTS. 24.1 The Purchaser hereby consents in terms of section 45 of the Magistrate’s Court Act, No. 32 of 1944, as amended, to the jurisdiction over any person under section 28 of that Act, notwithstanding that the value of the claim or the matter in dispute might otherwise exceed the jurisdiction of such Court. The Seller shall, however, have the right to institute action in any other Court of competent jurisdiction. The Purchaser agrees that, in the event of the Seller instructing its attorneys and/or proceeding in terms of clause 25 below and/or instituting legal proceedings against the Purchaser pursuant to a failure by the Purchaser to fulfil any of his obligations in terms hereof, then the Purchaser shall pay all legal costs together with VAT thereon incurred by the Seller in connection therewith as between attorney and own client, including collection commission (where applicable).
