23:03 When filled by a job posting. After such notice has been posted for five (5) working days, it shall be removed from the bulletin board or boards, and a copy of such notice shall be forwarded to the Union. If an employee is absent from the part-time Agreement applies forwork and during such absence a job posting is made, and is successfully appointed to replace a regular staff member on leave, for a period of up to twenty-four months, the status of the such employee from the part-time Agreement for purposes of future hiring is the same as before the employee was appointed to the position.
23:04 “Canadian Union of Public Employees, Local 1230” will be printed on all Job Postings for Full- Time Bargaining Unit positions.
23:05 Notwithstanding Articles 23:01, 23:02, 24:01, 24:02, 24:03, 24:04, 24:05, 25:01 the Employer and the Union may waive the above articles by mutual agreement. The Employer shall advise the Union of any positions affected by this article.
23:06 When considered an applicant provided he or a position has been filled arising out of Article 23:01, the Chief Union ▇▇▇▇▇▇▇ will be advised of acting as agent and upon his request affixes the selection of employee's name to the successful candidate posting within the stipulated five (5) working daysday period. The Company shall, within three (3) working days after the notice has been removed, post on the same bulletin board or boards for at least five (5) working days the name and length of service of the successful applicant, a copy of which shall also be forwarded to the Union. Employees are limited to one successful job application per six (6) month period. JOB POSTING. 23:01 At least seven 19.01 whenever a vacancy for a Home Position occurs, the Com- pany will notify the Union of their intention to fill the posi- tion.
19.02 whenever a vacancy in a home position is expected to last over twenty-one (721) working calendar days prior (except where the vacancy is caused by absence of an employee due to making any permanent staff changes covered ill- ness, accident, or leave of absence, refer to article 19.06 (a)), it will be posted on the recognized bulletin boards at 10:00 a.m. on the thursday following the vacancy, unless mutually agreed to between the company and the union. the posting will be removed from the boards on the next tuesday at 10 a.m. an active (does not include Ltd) employee wishing to ap- ply for the posted home position must submit a written ap- plication signed in triplicate by the terms employee and initialed by a supervisor or production representative no later than tuesday 10 a.m. a copy will be given to the plant chairper- son and the employee. the successful applicant will be chosen on the basis of this Agreementseniority and qualifications and his/ her name will be posted, together with the time, on the fol- lowing Monday he/she is expected to report to the new job. Such posting will be done no later than 5 p.m. wednesday. the successful applicant in all cases must report to the job at the beginning of the work week following the week during which he/she was chosen, except in cases such as indicated S & a, scheduled vacation, leave of absence, etc. transfers within a home position will be allowed, if senior to applicant, but will not result in Article 23:05an additional posting. 19.03 Once an employee has been notified through the company official job posting results notice (on the recognized bul- letin boards) that he/she has been accepted for posted job, he/she will then have no further claim to his/her former job beyond the work week in which he/she is so notified except in the Employercase of that weekend overtime. Should a dispute arise as to an applicant’s officesqualifications to do the job, and he/she will be given a five (5) day trial period or longer if mutually agreed to by the parties in which to prove himself/herself. However, if he/she fails to qualify, or re- quests to be taken off the job, within a ten (10) day period, he/she will be placed by the company on any available job in the bulletin boards plant for the balance of the Library [three ninety (390) of day period. In such case, the company will then fill the job with the next applicant in line with seniority. Should there be no other applicant(s) then the job will again be posted. In no case, will any other employee be entitled to claim pay for the time during which shall be locked cases], an employee is trying out for a posted job.
19.04 It is agreed by the company and notify the Union, in writing, in order union that all members will know about the position and be able to make written application therefore. 19.05 It is agreed that all new jobs, and salary rate jobs left vacant by em- ployees quitting or salary range. f) In all cases temporary posting(s) will be reposted after 12 months from effective date of the original posting. the company and union may make application for any vacant position arising mutually agree upon perma- nently posting long term vacancies.

23:03 When an employee from 19.08 employees posting on “Special Projects” will not give up his/her regular posting but will not have any rights to any overtime on his/her original job during the partSpecial assign- ment, until all hours in his/her classification are exhausted.
19.09 trained back-time Agreement applies for, and is successfully appointed ups for Key Position
a) the Company will maintain a list of employees to be used for key positions in the plant operations to replace a regular staff member on leave, for a period posted employees during any time of up temporary ab- sence (less than 45 days) or to twenty-four months, the status of the employee from the part-time Agreement for purposes of future hiring is the same as before the employee was appointed to the position.

c) the Company will determine the required number of trained back-ups required based upon business con- ditions. when it is determined that additional trained back-ups are required, the plant will be advised of canvassed using the selection of the successful candidate within five (5) working daysposting procedure.
23:07 The requirement d) Successfully posted employees to post a position as provided be trained in Article 23:01: JOB POSTING shall key posi- tions will receive the rate of pay of their current posted classification, but will not apply where employees are reassigned and/or relocated have rights to any overtime on his/her original job during the training assignment in accordance with and pursuant to Articles 35:02 and 35:03the area required.
23:08 e) If a trained employee is returned to the area in which he/she has been trained for a temporary assignment, he/she will continue to be eligible for overtime in his/her posted classification as per this Collective agreement.
f) Previously posted employees to key positions may be considered trained back-ups for those positions, upon agreement from the individual.
g) In order to keep all trained back-up employees current, opportunities to fill vacancies will be assigned to the event of layoffsem- ployee i.) on shift, ii) who has not filled the position for the longest period, whenever possible.
h) trained back-ups for key positions may request to be removed from the trained back-up list thirty-six (36) months after his/her name was added. 18.06 Vacancies which are not expected to exceed six (6) months, will not be posted and may be filled at the discretion of the Clinic. In filling such vacancies consideration shall be give to employees in writingthe bargaining unit who have recorded their interest in writing prior to considering persons not employed by the Clinic, except in order that all members cases of lay-off where Article 17.05 applies. In considering such employees the criteria for selection in Article 18.04 shall apply. 18.07 The Clinic shall have the right to fill a posted vacancy on a temporary basis to allow for posting and a completion of arrangements to permit the employee selected to fill the vacancy. No grievance may be filed concerning such temporary arrangements.
18.08 Once a successful applicant to a job posting has been selected, such employee shall have a period of 30 working days to determine if she wishes to continue in the position and be able the employer shall have the opportunity to make written application thereforeevaluate if the employee is capable of performing the work. For purposes of this section, “seniority” shall mean Employer Seniority accrued at this unit. 12.03 Where the Employer determines that a temporary vacancy in excess of six (6) months is to be filled within the bargaining unit, the Employer shall post the temporary vacancy. 12.04 In filling a vacancy in an existing or new position, the ability of the applicant to satisfy the job requirements, as determined by the Employer, shall be the governing consideration; provided, however, where the relative ability to satisfy the job requirements is equal, bargaining unit seniority will govern. Notwithstanding the above, the Employer may award the position to the most senior applicant without conducting interviews.
12.05 Only those positions that cannot be filled by a bargaining unit member who meets the stated qualifications, skills, and abilities for the position shall be open to applicants outside the bargaining unit.
12.06 If a successful applicant, from within the bargaining unit, is found unsatisfactory in the position or, if the employee finds herself unable to perform the duties of the position, job descriptionthe employee shall be placed in her former position, required knowledge and education, ability and skills, hours of work, and salary rate or salary range. All notices shall include information regarding if the selection process (e.g.position no longer exists, the selection process for eligibleemployee’s rights shall be governed by Article 13. 23:05 Notwithstanding Articles 23:01, 23:02, 24:01, 24:02, 24:03, 24:04, 24:05, 25:01 the Employer and the Union may waive the above articles by mutual agreement. The Employer shall advise the Union of any positions affected by this article.

16.02 The Company, in filling such a new job or vacancy shall give preference to the employee having the greatest seniority, skill and ability to perform the job. The successful candidate for a job posting will be given a Fifteen (15) working day trial period. If, during this Fifteen (15) working day period, the employee is not capable of performing the work adequately, or if the employee decides he does not want the job (excluding new business launches), he will be returned to his previous classification without loss of seniority.
16.03 When an employee has been transferred pursuant to Articles 35:02 the provisions of paragraph
16.01 such employee shall not again become eligible to be transferred until a period of three (3) months has elapsed. Employees who post and 35:03decline an offer of transfer shall not again become eligible to transfer until a period of six (6) months. An employee shall only be entitled to two (2) transfers in any one (1) calendar year.
23:08 In the event of layoffs, the Employer will arrange to set up a liaison between the laid-off employees and the Library Manager of Personnel Services.

This period may be extended beyond twelve (12) months on mutual agreement between the parties. Agreement to an extension of this period will not be unreasonably withheld.
c) An employee who is laid off shall be provided by regular or electronic mail at the employee’s last known address with copies of job postings for a period of twenty-four (24) months from the last day at work.
d) Lateral Transfers within the Corporation
i) When a permanent vacancy occurs in the bargaining unit, and a permanent employee in the same position as provided the vacancy wishes to transfer laterally to that vacancy, the employee shall request the transfer, in writing, quoting the job posting number prior to the closing date of the posting.
ii) A permanent employee submitting such request shall be assigned to the vacancy based on seniority. Such a transfer can only be made on one occasion within a twelve (12) months period. The transferred employee can apply to other vacancies within the twelve (12) months period and be considered subject to the relevant provisions in Article 23:01: JOB POSTING 9 “Job Posting”.
iii) It is understood that when it is necessary to assign an employee in accordance with this Article, the provisions of Article 9.04 shall not apply where employees are reassigned and/or relocated in accordance with and pursuant to Articles 35:02 and 35:03for the vacancy.
23:08 9.02 In all cases of promotions, demotions, transfers and recalls, seniority shall be the event of layoffs, governing factor provided the Employer will arrange senior employee is qualified and competent to set up do the work. JOB POSTING. 23:01 At least seven 16.01 With respect to any new positions or any vacancies coming within the scope of this agreement, Employees shall be entitled to bid for such position or vacancy by means of written application. Employees already in the same classification will be automatically considered for the job vacancy and do not have to reapply for a job within the same classification. 23:08 In 21:09 The Employer may establish eligibility lists for specific positions, by pre‐posting positions and selecting candidates in advance. When this occurs, the event of layoffs, Association will be notified in writing.
21:10 All staffing actions by the Employer will arrange be done in a fair and reasonable manner. The knowledge, skills, abilities, experience, and qualifications required in the posting shall be reasonable in relation to set up the position being filled. Candidates who have: unsatisfactory attendance or performance; documented disciplinary action on file within the last two years relating to harassment, discrimination or violence in the workplace; or other documented disciplinary action on file within one year of the competition will not be eligible for the job vacancy.
21:11 The job posting process described above does not apply to the firefighter Level.
21:12 The job posting will be advertised among all employees of the GTAA. The Employer agrees that members of the bargaining unit will be given priority over external applicants.
21:13 Acting Assignments
(a) Acting lists will be established every three (3) years to select Acting Officers. The number of Acting Officers will be at the Employer's discretion.
(i) In order to participate in the Acting Captain process the following shall be met:
a) All participants shall have been a liaison between GTAA First Class Firefighter for the laid-off employees last two (2) years; and
b) In order to act, a Firefighter shall have three (3) years' as a GTAA First Class Firefighter.
(ii) In order to participate in the Acting Platoon Chief process a Captain shall have a minimum of two (2) years' experience as a GTAA Operational Captain, unless deemed competent by management to enter the process early.
(iii) In order to participate in the Acting Division Chief process in either Fire Prevention or Training an Officer shall have a minimum of four (4) years' experience in their respective division, unless deemed competent by management to enter the process early.
(b) Acting Process A process to validate knowledge, skills, abilities, experience and qualifications will be determined by the Library Manager Employer and communicated at the start of Personnel Servicesthe process. Successful Candidates must obtain a passing overall average of seventy‐five percent (70%) and agree to a shift change if necessary. Within thirty (30) days of the final selections, all candidates, if requested, shall have a schedule interview with the Chief or designate for the purpose of reviewing the results of all components of the process both verbally and in writing. Candidates who have: unsatisfactory attendance or performance; documented disciplinary action on file within the last two years relating to harassment, discrimination or violence in the workplace; or other documented disciplinary action on file within one year of the competition, will not be eligible for Acting competitions.

15.02 Vacancies created by the filling of a posted vacancy under Article 15.01(ii) need not be posted, however consideration for such subsequent vacancies will be given to employees in this bargaining unit who have a request for transfer on file. The maximum number of positions to which an employee may request a transfer at any one time is four (4). Requests for transfer shall become active upon receipt and must be renewed during the month of January of each year to remain so.
15.03 Employees shall be selected for positions under either Article .01 or .02 on the basis of their ability, experience and qualifications. Where these factors are relatively equal amongst the employees considered, seniority shall govern providing the successful applicant, if any, is qualified to perform the available work. The name of the successful candidate within five (5) working daysapplicant will be posted on the bulletin board and unsuccessful applicants will be notified.
23:07 The requirement 15.04 Where there are no successful applicants from within this bargaining unit for positions referred to post a position as provided in Article 23:01: JOB POSTING .01 and .02 employees in other SEIU service bargaining units at the Employer’s operation will be considered for such positions prior to considering persons not employed by the Employer. The employees eligible for consideration shall not apply where be limited to those employees are reassigned and/or relocated who have applied for the position in accordance with Article .01 and pursuant to Articles 35:02 .02, and 35:03selection shall be made in accordance with Article .03 above.
23:08 15.05 Vacancies which are not expected to exceed three (3) months will not be posted and may be filled at the discretion of the Employer. In filling such vacancies consideration shall be given to part-time employees in SEIU service bargaining units who have recorded their interest in accordance with .02 above prior to considering persons not employed by the event Employer. In considering such part- time employees the criteria for selection in .03 shall apply. Part-time employees selected to fill a vacancy under this Article will continue to maintain their part-time status and upon completion of layoffsthe assignment the employee will return to his/her former position.
15.06 The Employer shall have the right to fill any vacancy on an interim basis until the posting procedure or the Request for Transfer procedure provided herein has been complied with, and arrangements have been made to assign the employee selected to fill the vacancy on the job. No grievance may be filed concerning such temporary arrangements.
15.07 The successful applicant will be placed in the vacancy for a trial period not exceeding forty-five (45) working days and if the employee proves satisfactory, then he shall be considered permanently assigned to the vacancy. If the employee proves unsatisfactory during that time, or if the employee feels he/she is unable to perform the duties of the vacancy to which he/she is posted, the Employer employee will arrange be returned to his former position at this former salary or rate of pay, as will any other employee in the Bargaining Unit who was promoted or transferred by reason of such placing. Newly hired employees shall be terminated and such termination shall not be subject to the grievance and arbitration procedure.
15.08 If the successful applicant does not complete the trial period as set up a liaison between out in Article 15.07, the laidposition shall be re-off employees and the Library Manager of Personnel Servicesposted.

23:02 Any 25.02 Employees shall have the right to bid during such seven (7) day period on any such vacancy or new job created. Such vacancy or new job created shall be filled from the applications received on the basis of seniority provided the senior employee in possesses the Bargaining Unit may make application for any vacant position arising out necessary qualifications and experience to perform the normal requirements of Article 23:01 in the Part-time Collective Agreement or Article 23:01 in the Full-time Collective Agreementjob. All positions will be posted on the Board’s Web Page. It is understood that any vacancies which must be filled in the interim may be filled by casual employees.
23:07 The requirement c. All new or vacant permanent positions shall be posted within fourteen (14) days after the Employer becomes aware of the opening, but not earlier than thirty (30) calendar days prior to post the date the position is to become available or vacant.

ARTICLE 12.02 Promotions and transfers to a vacancy for regular employment within the bargaining unit will be based upon the abilities and qualifications of an employee to satisfactorily perform the work involved. As between employees whose abilities and qualifications are relatively equal, seniority will govern.
ARTICLE 12.03 In the event of layoffsno employee possesses the abilities and qualifications to satisfactorily perform the work involved, the Employer will arrange Board may elect, at its discretion, to set up train an employee or to engage a liaison between the laid-off employees and the Library Manager of Personnel Servicesnew employee.

JOB POSTING. 23:01 At least seven In the event that a new job is created or the Employer determines that a permanent vacancy exists in the bargaining unit, such jobs or vacancies shall be filled as follows:

The maximum number of positions to which an employee may request a transfer at any one time is four (4). 23:08 17.05 Vacancies which are not expected to exceed three (3) months will not be posted and may be filled at the discretion of the Employer. In filling such vacancies consideration shall be given to part-time employees who have recorded their interest in accordance with 17.02 above prior to considering persons not employed by the event Employer. In considering such part-time employees the criteria for selection in 17.03 shall apply. Part-time employees selected to fill a vacancy under this Article will continue to maintain their part-time status and upon completion of layoffsthe assignment the employee will return to her former position.
17.06 The Employer shall have the right to fill any vacancy on an interim basis until the posting procedure or the Request for Transfer procedure provided herein has been complied with, and arrangements have been made to assign the employee selected to fill the vacancy on the job. No grievance may be filed concerning such temporary arrangements.
17.07 The successful applicant will be placed in the vacancy for a trial period not exceeding forty-five (45) working days and if the employee proves satisfactory, then she shall be considered permanently assigned to the vacancy. If the employee proves unsatisfactory during that time, or if the employee feels she is unable to perform the duties of the vacancy to which she is posted, the Employer employee will arrange be returned to her former position at her former salary or rate of pay, as will any other employee in the employee group who was promoted or transferred by reason of such placing. Newly hired employees shall be terminated and such termination shall not be subject to the grievance and arbitration procedure.

Part- time employees selected to fill a vacancy under this Article will arrange continue to set up maintain their part-time status and upon completion of the assignment the employee will return to his former position.
11.06 The Centre shall have the right to fill any vacancy on an interim basis until the posting procedure herein has been complied with, and arrangements have been made to assign the employee selected to fill the vacancy to the job. No grievance may be filed concerning such temporary arrangements.
11.07 The successful applicant will be placed in the vacancy for a liaison between trial period not exceeding forty-five (45) working days and if the laid-off employee proves satisfactory, then he shall be considered permanently assigned to the vacancy. If the employee proves unsatisfactory during that time, or if the employee feels he is unable to perform the duties of the vacancy to which he is posted, the employee will be returned to his former position at his former salary or rate of pay, as will any other employee in the Bargaining Unit who was promoted or transferred by reason of such placing. Newly hired employees shall be terminated and such termination shall not be subject to the Library Manager grievance and arbitration procedure.
11.08 Successful applicants and newly hired employees will not be permitted to apply for job postings or any subsequent vacancies for a period of Personnel Servicessix (6) months, unless otherwise mutually agreed.

JOB POSTING. 23:01 At least 19.01 When a permanent vacancy occurs in the Long Term Care Home, either in any existing position or because a new job is created coming within the scope of this Agreement, a notice will be posted within seven (7) working days prior to making any permanent staff changes covered by the terms of this Agreement, except as indicated in Article 23:05, the Employer first which will post notice enable employees of the said position in Long Term Care Home to apply for the Employer’s offices, and on position. Upon successful promotion an employee will be placed on the rate in the new scale which represents an increase. If a full time vacancy becomes available and no full-time member applies for the position, the vacancy will be filled from among the part-time members who have applied, based on skill and ability. Where the skill and ability of two or more candidates are deemed relatively equal by the Employer, the person with the greater seniority will receive the position
19.03 In the event the successful applicant, within thirty (30) working days of commencing work in the posted position or such longer period as may be mutually agreed upon in writing, in order that all members will know about proves unsatisfactory to the Employer or requests a return to her former position she shall be returned to her former position without loss of seniority.
19.04 In the event an employee returns to her former position under 19.04, any other employee promoted or transferred as a result of the rearrangement of positions shall also be returned to her former position without loss of seniority.

JOB POSTING. 23:01 At least
9.01 For purposes of this Article, vacancies shall mean those vacancies in permanent or temporary positions anticipated to extend beyond thirty (30) working days.
a) The secretary of the Union shall be provided with a copy of all job postings by way of regular or electronic mail.
b) For the purpose of Article 9, temporary positions shall be a position established or a vacancy in a permanent position for a period of twelve (12) months or less. This period may be extended beyond twelve (12) months on mutual agreement between the parties. Agreement to an extension of this period will not be unreasonably withheld.
c) An employee who is laid off shall be provided by regular or electronic mail at the employee’s last known address with copies of job postings for a period of twenty-four (24) months from the last day at work.
d) Lateral Transfers within the Housing Corporation
i) When a permanent vacancy occurs in the bargaining unit, and a permanent employee in the same position as the vacancy wishes to transfer laterally to that vacancy, the employee shall request the transfer, in writing, quoting the job posting number prior to the closing date of the posting.
ii) A permanent employee submitting such request shall be assigned to the vacancy based on seniority. Such a transfer can only be made on one occasion within a twelve (12) months period. The transferred employee can apply to other vacancies within the twelve (12) months period and be considered subject to the relevant provisions in Article 9 - Staff Changes.
iii) It is understood that when it is necessary to assign an employee in accordance with this Article, the provisions of Article 9.04 shall not apply for the vacancy.
9.02 In all cases of promotions, demotions, transfers and recalls, seniority shall be the governing factor provided the senior employee is qualified and competent to do the work. Seniority shall operate on a bargaining-unit-wide basis.
9.03 Posting of New Positions and Permanent Vacancies

JOB POSTING. 23:01 At least 29.01 Any new position or permanent vacancy as determined by management shall be posted on the bulletin board that the employees read from, for not less than seven (7) working days prior to making any permanent staff changes covered consecutive calendar days. An employee whose status is changed from part-time to full-time shall receive credit for her full seniority and service on the basis of one year of seniority for each hours paid. Any time worked in excess of an equivalent shall be prorated at the time of transfer. Any temporary vacancy with an anticipated duration of six (6) weeks or more will be posted. Employees working less than thirty-seven and one-half (37%) hours a week shall be given the first opportunity to fill temporary vacancies, subject to Article The Employer will outline to the employee selected to fill the vacancy the anticipated conditions and duration of such vacancy. An employee returning from leave of absence shall have the right to return to her former position. JOB POSTING. 23:01 The Public Services Director shall be the sole determiner as to the need or necessity to fill any vacancy or new position.
A. If the Public Services Director determines the need to fill a vacancy or new position, the opening will be posted as follows:
1) The Public Services Director will provide notice to Public Services Solid Waste Division employees who are in the same job classification about the vacant position. Those employees may indicate in writing their desire to fill the vacancy. If two (2) or more employees wish to transfer, the transfer shall be given to the most senior employee. Once the vacant position has been filled by the most senior interested employee, there will be no further changes internally regarding the filling of any other vacancies. This is commonly referred to as “one and done”. This approach and transfer/assignment has a duration until the next annual bid. At least that time, employees are eligible to bid on positions based on seniority. For example, if an employee retires in May, then the “one and done” filling will occur and exist from May until the December annual bid. At the annual bid all positions are open based on seniority.
2) In regards to the position vacated based on 1) above (one and done), the vacated position will be filled by way of the normal recruitment process whereby the position is posted simultaneously for all county employees and external applicants via advertising for a period of seven (7) working to fourteen (14) days prior to making any permanent staff changes covered by the terms Human Resources Department. The Human Resources Department provides a copy of this Agreement, except the posting to the Union. Solid Waste employees within the same job classification as indicated the vacancy are not permitted to apply (if allowed would result in Article 23:05mini shift selections creating a ripple effect which is very challenging for management to address and is an inefficient disturbance of the pattern of work for existing scheduled employees).
3) If a vacancy occurs in a position with the same job classification and minimum requirements of a prior job announcement, the Employer first will post notice Public Services Director may select a candidate from the applicant pool from the previous recruitment. The vacancy must occur within ninety (90) days of the said position in the Employer’s offices, and on the bulletin boards closing date of the Library [three (3) of which shall be locked cases]previous job announcement.
B. The Public Services Director or designee will provide notice to Solid Waste Division employees to allow one and only one most senior employee, and notify the Union, who indicates in writing, in order that all members their desire to transfer to the vacant position within the job classification.
C. Once the most senior employee has been transferred into the vacant position, the Department will know about post the backfill position and be able to make written application thereforeexternally. Further, an electronic copy External posting will be posted for distribution. As between employees whose abilities and qualifications are relatively equal, seniority will govern.
ARTICLE 12.03 In the event of layoffsno employee possesses the abilities and qualifications to satisfactorily perform the work involved, the Employer will arrange Board may elect, at its discretion, to set up train an employee or to engage a liaison between the laid-off employees and the Library Manager of Personnel Servicesnew employee.
