Common use of IRO Engagement Clause in Contracts

IRO Engagement. Medco shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and/or objective fashion, as set forth in Paragraph D. Within thirty (30) days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco may continue to engage the IRO. If Medco engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Medco shall submit the information identified in Section V.A.8 to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco may continue to engage the IRO.

IRO Engagement. Medco Rotech shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and/or and objective fashion, as set forth in Paragraph D. Within thirty (30) 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Rotech if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Rotech may continue to engage the IRO. If Medco Rotech engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Medco Rotech shall submit the information identified in Section V.A.8 of the CIA to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Rotech if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Rotech may continue to engage the IRO.

IRO Engagement. Medco Zimmer shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and/or and objective fashion, as set forth in Paragraph D. Within thirty (30) 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Zimmer if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Zimmer may continue to engage the IRO. If Medco Zimmer engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Medco Zimmer shall submit the information identified in Section V.A.8 V.A.11 to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Zimmer if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Zimmer may continue to engage the IRO.

IRO Engagement. Medco InterMune shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and/or objective fashion, as set forth in Paragraph D. Within thirty (30) 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco InterMune if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco InterMune may continue to engage the IRO. If Medco InterMune engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Medco InterMune shall submit the information identified in Section V.A.8 V.A.9 to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco InterMune ‘if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco InterMune may continue to engage the IRO.

IRO Engagement. Medco HealthSouth shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and/or objective fashion, as set forth in Paragraph D. Within thirty (30) 30 days after the OIG receives written notice of the identity of the selected IRO, the OIG will notify Medco HealthSouth if the IRO is unacceptable. Absent notification from the OIG that the IRO is unacceptable, Medco HealthSouth may continue to engage the IRO. If Medco HealthSouth engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Medco HealthSouth shall submit the information identified in Section V.A.8 IV.A.3 of this Addendum to the CIA to the OIG within 30 days of engagement of the IRO. Within 30 days after the OIG receives written notice of the identity of the selected IRO, the OIG will notify Medco HealthSouth if the IRO is unacceptable. Absent notification from the OIG that the IRO is unacceptable, Medco HealthSouth may continue to engage the IRO.

IRO Engagement. Medco Polymedica shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and/or objective fashion, as set forth in Paragraph D. Within thirty (30) 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Polymedica if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Polymedica may continue to engage the IRO. If Medco Polymedica engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Medco Polymedica shall submit the information identified in Section V.A.8 to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Polymedica if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Polymedica may continue to engage the IRO.

IRO Engagement. Medco Biovail shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the its review in a professionally independent and/or and objective fashion, as set forth in Paragraph D. Within thirty (30) 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Biovail if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Biovail may continue to engage the IRO. If Medco Biovail engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Medco Biovail shall submit the information identified in Section V.A.8 V.A.7 of the CIA to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Biovail if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Biovail may continue to engage the IRO.

Absent notification from OIG that the IRO is unacceptable, Medco HealthSouth may continue to engage the IRO. If Medco HealthSouth engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Medco HealthSouth shall submit the information identified in Section V.A.8 to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco HealthSouth if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco HealthSouth may continue to engage the IRO.

IRO Engagement. Medco Allergan shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and/or and objective fashion, as set forth in Paragraph D. Within thirty (30) 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Allergan if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Allergan may continue to engage the IRO. If Medco Allergan engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Medco Allergan shall submit the information identified in Section V.A.8 V.A.10 of the CIA to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Allergan if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Allergan may continue to engage the IRO.

IRO Engagement. Medco Gambro shall engage an IRO that possesses the qualifications set forth in Paragraph B, below, to perform the responsibilities in Paragraph C, below. The IRO shall conduct the review in a professionally independent and/or objective fashion, as set forth in Paragraph D. Within thirty (30) 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Gambro if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Gambro may continue to engage the IRO. If Medco Gambro engages a new IRO during the term of the CIA, this IRO shall also meet the requirements of this Appendix. If a new IRO is engaged, Medco Gambro shall submit the information identified in Section V.A.8 to OIG within 30 days of engagement of the IRO. Within 30 days after OIG receives written notice of the identity of the selected IRO, OIG will notify Medco Gambro if the IRO is unacceptable. Absent notification from OIG that the IRO is unacceptable, Medco Gambro may continue to engage the IRO.
