Investment Disclosure. The Issuer and the Noteholders, by their acceptance of the Equipment Notes or their interests therein, acknowledge that shares or investments in Permitted Investments or Indenture Investments are not obligations of Wilmington Trust Company, or any parent or affiliate of Wilmington Trust Company, are not deposits and are not insured by the FDIC. The Indenture Trustee or its affiliate may be compensated by mutual funds or other investments comprising Permitted Investments or Indenture Investments for services rendered in its capacity as investment advisor, or other service provider, and such compensation is both described in detail in the prospectuses for such funds or investments, and is in addition to the compensation, if any, paid to Wilmington Trust Company in its capacity as Indenture Trustee hereunder. The Issuer and Noteholders agree that the Indenture Trustee shall not be responsible for any losses or diminution in the value of the Indenture Accounts occurring as a result of the investment of funds in the Indenture Accounts in accordance with the terms hereof.

Purchaser has provided the Company with all the information that the Company has requested in connection with the decision to purchase the Stock. The Company further represents that the Company has had an opportunity to ask questions and receive answers from Purchaser regarding the business, properties, prospects and financial condition of Purchaser. All such questions have been answered to the full satisfaction of the Company.
Investment Disclosure. The Purchaser has reviewed information provided by Company in connection with the decision to purchase the Stock, including the Company’s most recent financial statements. Company has provided the Purchaser with all the information that the Purchaser has requested in connection with the decision to purchase the Stock. The Purchaser further represents that Purchaser has had an opportunity to ask questions and receive answers from the Company regarding the business, properties, prospects and financial condition of the Company, and that all such questions have been answered to the full satisfaction of Purchaser.
Investment Disclosure. The Investor acknowledges and agrees that (a) the Investor has had access to and an opportunity to review documents, records, reports, and information regarding the Company (the "Documents") that --------- such Investor may have reasonably requested, and such Investor has completed its review of such Documents to its satisfaction, and (b) such Investor has had an opportunity to make inquiries of Company as to its financial condition, and to make other such inquiries of the Company that such Investor believes are necessary or appropriate to determine that it desires to enter into this Agreement, without reliance on or any advice, counsel, or persuasion from the Company or its agents or advisors.
