The 'Investigation Files' clause defines the rules and procedures regarding the creation, maintenance, and access to documents and records generated during an investigation. Typically, this clause outlines who is responsible for compiling the investigation files, what types of information must be included (such as reports, evidence, and correspondence), and who may review or obtain copies of these files. By establishing clear guidelines for handling investigation files, the clause ensures transparency, preserves the integrity of the investigative process, and helps prevent disputes over access to or the completeness of records.
Investigation Files. Internal investigation files shall not be retained longer than the current year plus three years from the date the investigation was initiated, except (a) as otherwise required by law; and (b) for cases that remain pending, are on appeal, are subject to a court requiring their preservation, or where pending civil, criminal, disciplinary, or administrative proceedings make it appropriate to retain the file for a longer period of time.
Investigation Files. Employee access to internal investigation files shall be governed by departmental regulations, and the provisions of Section 19.3.2 of this Agreement.
