In the case of Level 3 as a Receiving Party, BA may request, and Level 3 will then establish, geographically-relevant IPs by establishing a Level 3-IP at a Collocation site at each BA Tandem in a LATA (or, in the case of a single Tandem LATA, at each BA End Office Host), for those NXXs serving equivalent BA rate centers which subtend the BA Tandem (or BA End Office Host). For purposes of this Section 4.2.34.1, the Parties agree that Level 3-IPs at Collocation sites at the BA Tandems shown in Schedule 4.0 represent geographically relevant IPs for the LATAs listed in Schedule 4.0. In any LATA in which BA agrees that Level 3 may meet its obligation to establish geographically relevant IPs through a Collocation site at fewer than all of the BA Tandems (or BA End Office Host) in a LATA, including the LATAs identified in Schedule 4.0, then BA shall determine and advise Level 3 as to which Level 3 IP established at a Collocation site (or other available Level 3 IP) BA will deliver traffic from each relevant originating rate center or other originating location. At any time that Level 3 establishes a Collocation site at a BA End Office, then either Party may request that such Level 3 Collocation site be established as the Level 3-IP for traffic originated by BA Customers served by that End Office. Such request shall be negotiated pursuant to the Joint Grooming Plan process, and approval shall not be unreasonably withheld or delayed. each LATA where the Parties interconnect, CLEC and SBC ILLINOIS shall Interconnect their networks at the correspondingly identified SBC ILLINOIS Tandem Switch Center POIs and CLEC Switch Center POIs any POI location, (2) designate an OC- 3, OC-12, OC-24 or OC-48 interface for any POI located at an SBC ILLINOIS tandem or facility hubbing location, or CLEC switching center, or (3), with the mutual agreement of the Parties, select another technically feasible interface. The interface will be commensurate with reasonable forecast of interconnection traffic at that POI.\n3.2.4 Each Party shall: (i) provide trained personnel with adequate and compatible test equipment to work with each other's technicians, and (ii) provide maintenance and provisioning for their respective sides of the demarcation point.\n3.2.5 Point of Interconnection (POIs): A Point of Interconnection (POI) is a point in the network where the Parties deliver Interconnection traffic to each other, and also serves as a demarcation point between the facilities that each Party is responsible to provide. In many cases, multiple POI(s) may be necessary to increase operating efficiency for both parties. Both parties may negotiate the architecture in each location.\n3.2.5.1 Where SBC ILLINOIS\u2019 end offices subtend another ILEC\u2019s tandem switch for local traffic and/or exchange access, CLEC may, at its discretion, interconnect with SBC ILLINOIS for local traffic and/or exchange access utilizing the other ILEC\u2019s tandem switch or at the SBC ILLINOIS end office. If CLEC elects interconnection via the third party tandem switch, it shall designate a POI within the operating territory of SBC ILLINOIS and deliver its originating traffic to SBC ILLINOIS at this POI. Each party is responsible for the facilities on its side of any POI(s) established under such conditions. Each party is responsible for ensuring that any facilities provided by a third party on its side of any POI in such an interconnection arrangement comply with the provisions of this interconnection agreement. In such circumstances, SBC ILLINOIS shall remain responsible to deliver its originating traffic to CLEC at CLEC\u2019s switch or such other mutually agreeable POI(s). However, such switch or POI(s), whichever is applicable, must be within the LATA and within SBC ILLINOIS\u2019 operating territory where the traffic originates.\n3.2.5.2 Each Party is responsible for the facilities to its side of the POI(s). Each Party is responsible for the appropriate sizing, operation, and maintenance of the transport facility(ies) between its switch locations, and the applicable POI(s). The Parties agree to provide sufficient facilities for the Interconnection trunk groups for the exchange of traffic between CLEC and SBC ILLINOIS.\n3.2.6 If CLEC elects Collocation as an Interconnection method or the Parties agree to a network architecture that requires SBC ILLINOIS to Interconnect with CLEC's facilities via Collocation, CLEC agrees to provide to SBC ILLINOIS Collocation for purposes of that Interconnection set forth in Section 3.4.2. CLEC agrees that the provisions in Section 3.4.2 and any future Interconnection methods are non- discriminatory and no less favorable than CLEC provides to other similarly situated Telecommunications Carriers. Any such future Interconnection methods shall be submitted in the form of an amendment to the Commission for approval.\n3.2.7 In each LATA the Parties agree to provide, at a minimum, sufficient facilities so that a local Interconnection trunk group can be established from each CLEC Switch Center in the LATA to each, SBC ILLINOIS, combined local and Access Tandem or local Tandem, where CLEC originates or terminates local and/or toll traffic with SBC ILLINOIS.\n3.2.8 CLEC is solely responsible for the facilities that carry OS/DA, 911 or mass calling, and Meet-Point trunk groups.\n3.2.9 Either Party may combine originating local and intraLATA toll with exchange access traffic on Feature Group B and D exchange access trunks it obtains from the other Party.
