Common use of Instrument in Writing Clause in Contracts

Instrument in Writing. All actions which may be taken and all powers that may be exercised by the Holders at a meeting held as hereinbefore in this Article 9 provided may, subject to section 9.18, also be taken and exercised by the Holders of sixty-six and two-thirds percent (66 2/3%) of the aggregate principal amount of all the outstanding Notes, by an instrument in writing signed in one or more counterparts and the expression “Extraordinary Resolution” when used in this Note Indenture shall include an instrument so signed.
