Usage charges, monthly recurring charges, expedite charges, change charges, surcharges, charges for an unlisted or non-published number, any charges imposed by third parties (including access, egress, jack, or wiring charges), taxes or tax-like surcharges, or other Governmental Charges will not be waived. Toll Free Combined Feature Charges: Company will waive the standard Toll Free Combined Feature Package Charges during the Term.

Customer must satisfy the following conditions during the Term: The NPA/NXXs specified in agreement must maintain Secondary CFA Access from a Local Exchange Carrier or be provisions by Company Type 1 facilities (“Lit” Access) for every month during the Term. If Customer fails to satisfy this condition, then Company reserves the right to change the monthly pricing to $200 per DS1, $5,000 per DS3 and $10,000 per OC3. The NPA/NXXs specified in the agreement must maintain Secondary CFA Access from a Local Exchange Carrier or must be provisioned on Company Type 1 facilities (“Lit” Access) for every month during the Term. Company reserves the right to change monthly pricing for these loops to a mutually agreeable rate if this monitoring condition is not satisfied.
