INSPECTION AND EXPEDITING. Buyer, Xxxxx’s customer and/or, if different, the end-user (“Buyer Group”), and/or any official body concerned shall be entitled to inspect or test the Goods or work and to expedite progress of this order at any reasonable time at Supplier’s works or at the works of any of Supplier’s sub-contractors or assignees. Supplier will give Buyer adequate notice of Supplier’s and its subcontractors’ works tests which Buyer Group shall be entitled to attend. Supplier will provide Buyer with such test certificates as Buyer may require. Such inspection, testing and/or attendance by Xxxxx does not relieve Supplier of any liability nor does it imply acceptance of the Goods or work. Supplier shall promptly inform Buyer of any contact with any customers of Xxxxxxx, the end-user (if different) and/or any official body in connection with this order and shall not act upon any instruction from any of them unless confirmed in writing by Xxxxx. Supplier shall supply schedules and progress reports for Buyer Group’s use in expediting as required by the Buyer Group, and shall render all other assistance deemed reasonably necessary by Buyer Group. Any additional expediting costs incurred by Buyer Group due to a failure/rectification or delay of Supplier shall be borne by Supplier.

INSPECTION AND EXPEDITING. Seller shall be responsible for the performance of all activities affecting quality and schedule including those of its suppliers. Buyer shall have the right to reject any and all goods which fail to conform to the specifications under which they were purchased or to proper standards of workmanship. Buyer reserves the right to review Seller's Quality Assurance and Quality Control Procedures. Seller's Quality Plan submittal requirements, if applicable, are defined in the "Supplier Drawing and Data Commitment Form" section of this Purchase Order. The goods provided by Seller under this Purchase Order are subject to SQS inspection, expediting, audit of Quality Plan implementation and witnessing of Seller testing by the Buyer's representative and/or the Owner, who shall be granted access to all parts of the Seller's plant(s) or Seller's supplier's plant(s) engaged in the manufacturing or processing of this Purchase Order. The representative's inspection and witnessing of testing, or lack of inspection, witnessing of testing or response, shall in no way release the Seller from any obligations related to this Purchase Order. Seller shall further ensure that these terms and conditions become a part of its purchase orders to its suppliers for all goods or services which are used in the products purchased under this Purchase Order. Seller is further responsible for obtaining and submitting Quality Plans as required from its suppliers. Seller and/or Seller's suppliers will notify Buyer at least five (5) calendar days in advance of the date inspection or test can be made. If for any reason the date should be set back, Seller shall telephone, wire or facsimile Buyer immediately. NOTE: THE SELLER SHALL NOT SHIP THE GOODS ON THIS PURCHASE ORDER WITHOUT EITHER BUYER'S FINAL INSPECTION OR A WRITTEN WAIVER OF INSPECTION FROM BUYER. VIOLATION OF THIS REQUIREMENT SHALL CONSTITUTE A ® REJECTION OF THE GOODS, WITH SUBSEQUENT RETURN OR OTHER ACTION AT SELLER'S COST. Complete and accurate information is required to maintain the overall schedule. Unless otherwise stated, Seller shall at a minimum furnish every fourteen (14) days, status of engineering, material procurement, production and shipping information.
INSPECTION AND EXPEDITING. Contractor shall perform all inspection, expediting, quality surveillance and traffic services as are required for performance of the Services. Contractor shall perform such detailed inspection of all work in progress at intervals appropriate to the stage of construction or fabrication of the Facility Site as is necessary to ensure that such work is proceeding in accordance with this Agreement and the Design Documents and to protect Owner against defects and deficiencies in such work. On the basis of such inspections, Contractor shall keep Owner informed of the progress and quality of all work and shall provide Owner with written reports of deficiencies revealed through such inspections and of measures proposed by Contractor to remedy such deficiencies. Owner and Owner's designee(s) shall be given at least five (5) days' advance notice of, and shall have the option of being present at, all inspections and witness points off the Facility Site to be specified in the Quality Assurance Plan, and, in the event that the progress and quality of the work is not proceeding in accordance with this Agreement and the Design Documents, shall be entitled to make recommendations to Contractor for the purpose of remedying such deficiencies. In the event that Owner or Owner's designee(s) fails to be present for such inspection or witness point on the date scheduled therefor, Contractor may proceed with such inspection or witness point in Owner's or Owner's designee(s)'s absence. No inspection performed or failed to be performed by Owner or Owner's designee(s) hereunder shall be construed as a waiver of any of Contractor's obligations hereunder or be construed as an approval or acceptance of any of the Services. In addition, Contractor shall secure for Owner and its designees the inspection rights set forth in Section 2.1.13 hereof.
INSPECTION AND EXPEDITING. Contractor shall perform all inspection, expediting and quality surveillance that are required for performance of the TTMS Work on a timely basis. Contractor’s responsibilities under this Section 2.1.9 shall include, without limitation, inspecting all Contractor-supplied materials and equipment, both on and off the Project Right of Way that comprise or will comprise the TTMS Project or that are to be used in performance of the TTMS Work hereunder. Contractor shall perform a detailed inspection of all TTMS Work in progress at intervals appropriate to the stage of construction or fabrication off the Project Right of Way as is necessary to ensure that such TTMS Work is proceeding in accordance with this Agreement, the Xxxx Ex Design-Build Contract and the Comprehensive Agreement, and to protect Concessionaire against defects and deficiencies in such TTMS Work. On the basis of such inspections, Contractor shall keep Concessionaire continuously informed of the progress and quality of all TTMS Work and shall provide Concessionaire with written reports of deficiencies revealed through such inspections and of measures proposed by Contractor to remedy such deficiencies. Contractor shall use all reasonable efforts to secure for Concessionaire and the Department or their respective representatives the option of being present at all inspections of the TTMS Work Site. In the event that the progress and quality of the TTMS Work is not proceeding in accordance with this Agreement, the Xxxx Ex Design-Build Contract or the Comprehensive Agreement, Concessionaire shall be entitled to make recommendations to Contractor for the purpose of remedying such deficiencies. Contractor shall provide Concessionaire with a detailed list of materials and equipment inspection points. Contractor shall provide Concessionaire and the Department with at least five (5) days’ prior written notice of all inspections and on a monthly basis, Contractor shall advise Concessionaire and the Department of inspections planned for the forthcoming month. Concessionaire and the Department, and each of their designated representatives, shall have the right to be present at and participate in all inspections of the TTMS Work or the TTMS Work Site undertaken by Contractor. INSPECTION AND EXPEDITING. Buyer, or its representatives, shall have the right to expedite, inspect and witness testing of the goods or services ordered hereunder at any time prior to delivery or performance, and to finally inspect such goods and results of such services within a reasonable time after delivery at the ultimate destination of the goods or at completion of the performance of services. The goods or services shall not be deemed accepted until after such final inspection. The Buyer’s inspection or failure to make any inspection of, or payment for, or acceptance of, the goods or services, shall in no way release the Supplier from any obligations related to this Order, nor impair Buyer’s right to reject or revoke its acceptance of nonconforming goods and services or to seek any other remedies to which Buyer may be entitled. Supplier shall be responsible for all inspections required to comply with all applicable federal, state and local laws, ordinances, regulations and manufacturer’s standards.

INSPECTION AND EXPEDITING. The Turnkey Contractor shall perform the inspection, expediting, quality surveillance and delivery services as are required for performance of the Work. The Turnkey Contractor’s responsibilities under this Section 3.1.7 shall include inspecting all materials and equipment both on and off the Facility Sites that comprise or will comprise any part of the Facilities or that are to be used in performance of the Work, including the start-up of the Facilities, and the Turnkey Contractor shall provide reasonable advance notice thereof to the MEP Participants. The MEP Participants and/or their representatives shall have the option at their own cost and expense of being present at all inspections reasonably requested to be so witnessed by them; provided, however that the MEP Participants shall make their inspection representatives available as reasonably required to support the Work Schedule. In the event of the failure by MEP Participants or MEP Participants’ Representatives to attend any reasonably requested inspection, the Turnkey Contractor shall be entitled to proceed with such inspection.
