Initiation of Service. Constellation will begin providing electricity supply service to you after the Utility processes your enrollment and your service will continue throughout the term of this Contract. The Utility will notify you of the date on which your electricity supply service from Constellation will begin. Constellation’s electricity supply service will be delivered to your residence using the Utility’s electricity distribution wires. You represent and warrant that the electricity supply being purchased under this Contract is to be used solely for residential purposes.

The client has the right during the period of its subscription to modify the list of its users by providing to Simdex the necessary information. Activation and duration of service The Online Service is activated for the client on the following conditions: - the order form is correctly filled in by the client and contains the required information - the order form has been received and registered by Simdex and the Order has been paid to Simdex - Simdex has had the material time to activate the subscription. The Service is active for the client during the whole period of the subscription. At the end of the subscription period, the service will remain active only if the client has renewed and paid the subscription to the service. If the service is not renewed by the client, Simdex is not obliged to transfer to the client any information registered in the Online service by any of its users. Use of the Service Only direct employees of the client company can be eligible by the client to the service. The license to use the service by the users is exclusively reserved to the user. This license is personal and cannot be transferred even on a temporary basis to any other employee of the client company nor to any other person outside the company. In other words the user shall not allow any other person to use the service. The client understands that the transfer of the license to any person outside of the approved list of users is a breach of this agreement and that Simdex has the right to suspend the Online service to the client if evidence is provided that users of the client have not respected this rule. The user agrees not to copy, market, re-sell, distribute, retransmit, publish, compile a database, carry on any automated browsing or downloading or otherwise transfer or commercially exploit in any form any Simdex data or other than for the internal purposes of its business. The purpose of this document is to authorize Sunwave to change your electric generation service supplier to Sunwave and, by entering into this Agreement, you authorize Sunwave to undertake all steps reasonably required or necessary to accomplish your switch to Sunwave. Sunwave will begin providing electric generation service to you on the next applicable meter read date after the Utility processes your enrollment and your service will continue throughout the term of this Agreement. If you are currently taking service from another supplier and the enrollment with Sunwave fails to become effective on your next meter read date, you will be returned to standard service. You represent and warrant that the electric supply being purchased under this Agreement is to be used solely by you, and not for resale. Sunwave’s obligations under this Agreement are conditioned on you providing complete and accurate information to Sunwave and such information remaining accurate during the term of this Agreement, including remaining on the applicable rate class from time of pricing. Sunwave shall not be liable for any failure to enroll or drop an Account by the Start and End Date due to circumstances beyond Sunwave’s control.
