Common use of Initial Purchaser Information Clause in Contracts

Initial Purchaser Information. The Company acknowledge that the statements with respect to the offering of the Notes set forth in the third, fourteenth and fifteenth paragraphs under the heading “Plan of Distribution” in the Preliminary Offering Memorandum and the Offering Memorandum constitute the only written information relating to the Initial Purchasers furnished to the Company by or on behalf of the Initial Purchasers expressly for use in the Preliminary Offering Memorandum, the Disclosure Package and the Offering Memorandum, for purposes of Sections 2(a), 8(a) and 8(b) hereof (the “Initial Purchaser Information”).
