Initial Operating Period. During the Initial Operating Period (i) Provider shall deliver to Off-Taker and Off-Taker shall accept all Conforming Coke Tonnage, and (ii) Off-Taker shall accept any Nonconforming Coke Tonnage delivered by Provider as set forth in Section 5.1(d). The purchase price in respect of Conforming Coke Tonnage is the Coke Price, and in respect of such Nonconforming Coke Tonnage is the applicable price set forth in Section 5.1(d)(iii). Provider will also provide to Off-Taker on the first business day of each Week a nonbinding projection of (x) the duration of the Initial Operating Period, (y) Coke production for such Week, and (z) Coke production for each subsequent Week remaining in the Initial Operating Period.

Initial Operating Period. 19.1 "Initial Operating Period," as defined in the Bylaws, means the period of time commencing on the date that the Condominium is created and ending on the date which is sixty (60) days after units to which 75% of the Percentage Interests appertain have been conveyed by the Declarant or two (2) years from the conveyance of the first Unit, or on such earlier date as the Declarant in its sole discretion may determine. During the Initial Operating Period, at Declarant's election (i) the Declarant shall pay the costs of operating the Condominium and (ii) each Unit Owner, in lieu of an assessment, shall pay to the Declarant a fee in an amount equal to 90% of the units' estimated monthly condominium fee for each month (or portion of a month on a pro rata basis) during the Initial Operating Period that the Unit Owner owns a unit. The Declarant shall not be obligated to fund or otherwise contribute to any capital or other reserve for the Condominium during the Initial Operating Period.

Initial Operating Period. Section 1.1. During the initial operating period, beginning on the date of Entry into Force and ending at the time MCA-Cape Verde signs this Protocol, which period shall not exceed 180 days (the “Initial Operating Period”), the Ministry may act in place of MCA-Cape Verde to exercise the rights and perform the obligations of MCA-Cape Verde under this Protocol. During the Initial Operating Period, any references herein to rights and obligations of MCA-Cape Verde (including the responsibility of MCA Cape Verde to take certain actions) shall become the rights and obligations of the Ministry, on behalf of the Government. Following the Initial Operating Period, MCA-Cape Verde shall assume all rights and obligations of MCA-Cape Verde identified herein.

  • Transition Period Due to the nature of our purchasing process, the District often requires an existing service provider to continue to provide goods and/or services while the District is in the process of advertising, evaluating, and awarding a contract for the provision of the same goods and/or services in the future. To accommodate this process, the Contractor shall agree to maintain the same terms and conditions set forth in this Agreement for a period up to ninety (90) days after the automatic termination of this Agreement at the end of its term, if requested by the District, as a transition period. In addition, if the Contractor is not the successful bidder for a future solicitation for the same or similar services, he or she shall agree to provide the same goods and/or services provided in this Agreement for a period up to ninety (90) days to allow for an orderly transition to the new provider.
