Initial Civil Penalty. In settlement of all the claims referred to in the Notice and this Settlement Agreement, Vanroden, on or before the Effective Date, shall pay an initial civil penalty in the amount of $2,000. The initial civil penalty shall be apportioned in accordance with California Health & Safety Code § 25249.12(c) & (d), with 75% of these funds remitted to the State of California’s Office of Environmental Health Hazard Assessment (“OEHHA”) and the remaining 25% of the penalty remitted to Xxxxxx. Xxxxxxxx shall issue two separate checks for the penalty payment: (a) one check made payable to OEHHA in the amount of $1,500.00 representing 75% of the total penalty; and (b) one check to “The Chanler Group in Trust for Xxxxxxx X. Xxxxxx” in the amount of $500.00, representing 25% of the total penalty. The checks shall be delivered to the address listed in Section 3.3 below, and Xxxxxx shall have sole responsibility for promptly transmitting the OEHHA check to OEHHA .

Initial Civil Penalty. On or before the Effective Date, Midland shall pay an initial civil penalty in the amount of $2,000 in one check made payable to: “Xxxxxxxx Xxxxxxx, Client Trust Account.”
Initial Civil Penalty. Homestead shall pay an initial civil penalty in the amount of $6,000 on or before the Effective Date. Homestead shall issue two separate checks to: (a) “OEHHA” in the amount of $4,500; and (b) “Xxxx Xxxxxxx, Client Trust Account” in the amount of $1,500. All penalty payments shall be delivered to the addresses listed in Section 3.3 below.
Initial Civil Penalty. Within five days of the Effective Date, Coda shall make an initial civil penalty payment of $8,000. Coda agrees to provide its payment in a single check made payable to: “Xx. Xxxxxxx X. Xxxxxx, Client Trust Account.”
Initial Civil Penalty. On or before the Effective Date, Stansport shall pay an initial civil penalty of two thousand dollars ($2,000). Stansport agrees to provide its payment in a single check in the amount of two thousand dollars ($2,000) made payable to “Xxxx Xxxxx, Client Trust Account.”
Initial Civil Penalty. Radians shall pay an initial civil penalty in the amount of $6,000 on or before the Effective Date. Radians shall issue a check to: “Xxxxxxx X. Held, Ph.D., P.E., Client Trust Account” in the amount of $6,000. All penalty payments shall be delivered to the addresses listed in Section 3.3 below.
Initial Civil Penalty. Within five business days of the Effective Date, North States shall pay an initial civil penalty of $7,000. North States agrees to provide its payment in two checks for the following amounts made payable to: (a) “OEHHA” in the amount of $5,250; and (b) “Xxxx Xxxxxxxx, Client Trust Account” in the amount of $1,750.
Initial Civil Penalty. Within three weeks of the Effective Date, Whirlpool shall make an initial civil penalty payment of $5,000. Whirlpool agrees to provide its payment in a single check made payable to: “Xxxxxxx X. Held, Client Trust Account.”
Initial Civil Penalty. ICUP shall pay an initial civil penalty in the amount of $4,000 on or before July 16, 2015. ICUP shall issue the check payable to “Xxxxxxx X. Held, Client Trust Account.”
