Information Releases. The parties shall consult with each other (and allow the other party notice, and a reasonable time to comment) in preparing any employee announcement, press release, public announcement, news media response or other form of release of information concerning this Agreement or the transactions contemplated hereby that is intended to provide such information to the employees generally, news media or the public. Neither party shall issue or cause the publication of any press release, public announcement or media response without the prior written consent of the other party; provided, however, that, after allowing the other party notice and a reasonable time to comment prior to issuance, nothing herein will prohibit either party from making an employee announcement, or issuing or causing publication of any press release, public announcement or media response to the extent that such action is required by applicable Law or the rules of any national stock exchange applicable to such party or its Affiliates.
Information Releases. Purchaser and the Seller will jointly prepare and issue all releases of information relating to the sale. Subject to the prior sentence, if inquiries are made by any person with respect to any transaction contemplated by this Agreement, Seller and Purchaser will consult each other prior to responding to such inquiries.

Neither party will make a news release, publish articles, brochures, advertisements, issue prepared speeches or make any other information releases concerning this AGTA, or any Purchase Agreement entered into underneath this AGTA, without the prior written consent of the other party. Once such consent is obtained, the party making such disclosure will in each instance obtain the prior written approval of the other party concerning the exact test and timing of news releases, articles, brochures, advertisements, prepared speeches and other information releases concerning this AGTA or an applicable Purchase Agreement. Information Releases a. Press Releases. Contractor agrees that no brochure, news/media/press release, public announcement, memorandum or other information of any kind regarding the Contract, or relating to its activities under the Contract, shall be disseminated in any way to the public, nor shall any presentation be given regarding the Contract or those Contractor activities without the prior written approval of ITS, which written approval shall not be unreasonably withheld or delayed provided, however, that Contractor shall be authorized to provide copies of the Contract and answer any questions relating thereto to any State or Federal regulators or, in connection with its financial activities, to financial institutions for any private or public offering.
Information Releases. Notwithstanding the preceding provisions, 8bitstudio may publicly refer to Client, orally and in writing, as a Client of 8bitstudio. Any other reference to Client by 8bitstudio may be made only pursuant to a written agreement between the parties.

Except as may be required by law or the rules or regulations of the Securities and Exchange Commission, prior to the disclosure or dissemination of any publication, notice or press release by either party regarding the subject matter of this Agreement, written consent must be obtained from the other party as to content, means and timing of publication.

The parties agree that, except to the extent necessary to comply with the requirements of Applicable Law or any listing agreements with, or rules and regulations of, securities exchanges, no press release or similar public announcement or communication will ever, whether prior to or subsequent to the Closing, be made or caused to be made concerning the existence or subject matter of this Agreement unless approved in advance by the parties in writing; provided, that with respect to any press release or similar public announcement or communication for which advance approval is not required in accordance with the foregoing, to the extent practicable, reasonable notice and a copy of such release, announcement or communication will be provided to Purchaser or Sellers, as applicable, prior to issuing the same. Notwithstanding any provision to the contrary contained in this Agreement, the provisions of this Section 9.6 will survive the termination of this Agreement pursuant to Article VIII and the Closing.
Information Releases. During negotiations up to the point of impasse, periodic written progress reports may be issued to the public provided that any such release shall have the prior approval of both parties. During impasse release of information is permissible by either party unless the mediator directs otherwise.

No press release or public announcement -------------------- with respect to the transaction contemplated herein shall be made by either party without prior written approval of the other party, which approval shall not be unreasonably withheld, except as may be necessary, in the opinion of counsel for such party, to meet the requirements of any applicable law, regulation or ordinance, to comply with any request of any stock exchange on which the securities of such party may be listed or to enable such party to perform its obligations hereunder. It is expressly understood that this Lease Agreement, its contents and the provision of switching services may be disclosed by either party in connection with obtaining governmental approvals or any application for any permit, license, exemption or certification in connection with the provision of switching services.
