Inert Gas System. All Vessels fitted with an Inert Gas System (“IGS”) shall not be permitted to berth for loading or discharge of any Cargo unless the IGS is fully operational and all cargo tanks are inerted with an oxygen level at or below eight percent (8%). For Vessels intending to handle Cargo that could be adversely affected by inert gas, and for Cargo that does not require inert gas blanketing, Buyer may request from Seller an exemption from this paragraph at least three N e w Y o r k B a n k i n g Days prior to the Vessel’s arrival at the Cargo Transfer Point. For Vessels engaged in crude oil trade operations, positive inert gas pressure at or below eight percent (8%) oxygen content shall be maintained on all cargo tanks and slop tanks throughout the transfer and any COW operation. If Seller consents, manual gauging/sampling of OBQ or XXX xxx be accomplished per API MPMS Chapter 17.2 or any similar provision. Should the IGS fail after the Vessel has berthed, the Cargo transfer operation shall be terminated immediately and the Vessel may be ordered to vacate the berth until the IGS is fully operational and tanks are inerted to the requisite pre-arrival condition. Temporary or substitute equipment or procedures to correct IGS malfunctions may not be used without Seller’s approval. All expenses and time lost in connection with IGS failure and between berthings are for Xxxxx’s account.

Inert Gas System. The Owners warrants that the vessel has a working inert gas system and that the officers and crew are experienced in the operation of the system. The Owners further warrants that the vessel will arrive at load port with cargo tanks inerted when required by Charterers and that tanks will remain inerted throughout the voyage and during discharge. The vessel’s inert gas system shall fully comply with regulation 62, chapter 11-2 of the SOLAS Convention 1974 as modified by its protocol of 1978 and Owners’ undertake that such system shall be operated by the officers and crew in accordance with the operational procedures set out in the IMO publication entitled “Inert Gas System 1983” as may, from time to time, be amended. The Master may be requested by terminal personnel or independent inspector to breach the IGS for purpose of gauging, sampling, temperature determination and or determining the quantity of cargo remaining on board after discharge. The Master shall comply with these requests consistent with the safe operation of the vessel. If the Charterers so requires, the Owners shall arrange for the vessel’s tanks to be de-inerted to facilitate inspection, gauging and sampling. Any time taken in de-inerting, inspecting, gauging, sampling, and re-inerting thereafter shall count as on-hire.
Inert Gas System. Tanker should have an operational inert gas plant capable of maintaining tank atmosphere of less than 8 pct. Oxygen content and positive pressure in cargo tanks within safe limits at all stages of discharge.
Inert Gas System. 62.1 The Owners warrant that the Vessel is equipped with a fully functional, efficient and certified Class approved Inert Gas System (“IGS”) which is in use on the date of delivery of the Vessel and shall so remain during the period of the charter and that the officers and crew on board on delivery and throughout the period of the charter are and will be experienced in the operation of the system. The Owners further warrant that in case Charterers request so in writing the Vessel will arrive at load ports with cargo tanks inerted and that the tanks will remain inerted throughout the voyage and during discharge. In case, prior receipt of Charterers’ written request, vessel’s cargo tanks are not inerted, the inerting of the cargo tanks will be carried out at Charterers’ time, cost and expense, with the exception of the vessel’s delivery to Charterers when she will be presented inerted.

Any delay as a result of the Vessel not complying with this subsection III.I.1 shall not count as used laytime or as time on demurrage.

The master may be required by terminal personnel or independent surveyor(s) before and/or after discharge to breach the inert gas system for the purpose of gauging, sampling, temperature determination and/or determining the quantity of cargo remaining on board (ROB). The master shall comply with these requests consistent with the safe operation of the vessel. Vessel to remain on hire for such periods.

Inert Gas System. All Provided Vessels that are equipped with an inert gas system will keep the system operable at all times during berthing, while at berth and during unberthing. The Master of such a Provided Vessel will provide the Terminal with a signed declaration that the Provided Vessel's inert gas system is operational and that the cargo and slop tanks are inerted. The Master of the Provided Vessel will immediately notify the Terminal if the inert gas system becomes inoperable or if such a Provided Vessel is unable to maintain a positive pressure and/or oxygen content at or below eight (8%) percent by volume in the cargo and slop tanks. In addition, such a Provided Vessel will comply with any Terminal guidelines on inert gas systems. None of the Provided Vessels currently has inert gas systems.

Vessels intending to handle products or chemicals which could be adversely affected by inert gas, and such products or chemicals as do not require inert gas blanketing, should request an exemption from this Section at least three business days prior to entering the Terminal. For Vessels engaged in crude oil trade operations, positive inert gas pressure must be maintained on all Cargo and slop tanks throughout the transfer and any Crude Oil Washing (“COW”) operation. If required and if agreed by the Terminal, manual gauging/sampling of Onboard Quantity (“OBQ”) or Remaining on Board (“ROB”) may be accomplished per API MPMS Chapter 17.2. Should the IGS fail after the Vessel has berthed, the Cargo transfer operation or COW must be terminated immediately and the Vessel may be ordered to clear the berth until the IGS is fully operational and tanks are inerted to the pre-arrival condition. Costs and time associated with Vessel movement for IGS repair are for the Vessel Party’s account. The use of temporary or substitute equipment or procedures to correct IGS malfunctions must be accepted by the Terminal prior to readmittance to the Terminal, or for continuation of Vessel loading/discharging at the Terminal. Any Vessel time lost as a result of the Vessel not complying with all of the provisions in this Section does not count as used laytime or as time on demurrage.
