The 'Industry Best Practice' clause requires parties to perform their obligations in accordance with the highest standards commonly accepted within the relevant industry. In practice, this means that services or products provided must meet or exceed the quality, safety, and efficiency benchmarks typically observed among leading companies in the field. This clause ensures that the contracting party cannot simply meet minimum legal requirements but must strive for excellence, thereby reducing the risk of subpar performance and promoting reliability and trust between the parties.
Industry Best Practice. The Contractor must have in place and maintain security controls to protect Protected Information that conform to commonly accepted industry norms that a prudent operator providing similar services would have implemented. Without limitation, the Contractor will perform its obligations under this Schedule in a manner that best conforms to Industry Best Practice.
